APPENDIX A NOTICE OF DEVIATION ,

Nebraska Public Power District Docket: 50-298 '

Cooper Nuclear Station Operating License: DPR-46 Based on the results of an NRC inspection conducted on February 29 through March 2, 1988, a deviation of your commitments in the response dated August 31, 1979, to Inspection and Enforcement (IE) Bulletin No. 79-19, "Packaging of Low-Level Radioactive Waste for Transport and Burial," issued August 10, 1979, was identified. The deviation consisted of the failure to provide training and periodic retraining of personnel. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1987), the deviation is listed below:

Failure to Provide Training / Periodic Retraining IE Bulletin No. 79-19, issued August 10, 1979, requires, in part, that licensees who package low-level radioactive waste for transport and burial provide training and periodic retraining in the Department of Transportation and NRC regulatory requirements, the waste burial licensee requirements, licensee instructions and operating procedures for all personnel involved in the transfer, packaging, and transport of radioactive ,

material. The licensee submitted a response on August 31, 1979, stating i that a training / retraining program would be implemented.

In deviation from the above, the NRC inspector determined on March 2, 1988, l that all maintenance personnel involved with the handling and packaging of low-level radioactive waste offered for transport had not received periodic retraining since 1985 in the NRC regulatory requirements and the waste burial licensee reouirements. Nebraska Public Power District is hereby required to submit a written statement 1 or explanation to this Office within 30 days of the date of the letter i transmitting this Notice. This reply, should include for each deviation:

(1) the reason for the deviation if admitted, (2) the corrective steps that have  ;

been taken and the results achieved, (3) the corrective steps that will be taken i to avoid further deviations, and (4) the date when full conpliance will be  !

achieved. Where good cause is shown, consideration will be given to extending the response time.
