Dear Ms. Bernabei and Mr. Guild:
Submitted with the November 1984 motion to reopen you filed on behalf of Joint Intervenors in this proceeding were three copies each of three unexpurgated affidavits from persons who wished to remain anonymous.
The Appeal Board has kept all of these copies under seal.
See ALAB-812, 22 NRC 5, 17 n.8 (1985).
The Commission's Secretary, who was never served with a copy of these unexpurgated affidavits, has requested the Appeal Board to turn over these documents so that the official docket of this proceeding will be complete.
The Secretary will, of course, retain any such documents under seal.
In response to this request, the Board plans to turn over to the Secretary, as official custodian of the Commission's records (see 10 C.P.R.
S 2.702), one complete set of the three unexpurgated affidavits.
The two remaining duplicate sets will be destroyed.
Any objections to this action should be received by the Appeal Board 14 days from the date of this letter.
