1. The "monthly, quarterly, semi-annual or annual average effluent limitation by concentration means the arithmetic mean of.all the daily determinations of concentration made during any calendar month, 3 month, 6 month or 12 month period, respectively.
2. The "daily maximum" effluent limitation by concentration means the highest allowable reading of any daily determination of concentration.
3. "Daily determination of concentration" means one analysis performed on any given sample representing 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> flow, or during a 24-hour period or an operating day with one number in mg/l as an outcome.
4. "Grab Sample" means an individual sample collected in less than 15 minutes.
5. "Composite Sample" means a combination of individual samples '

obtained at least at hourly intervals over a time period.

Either the volume of each individual sample is proportional to discharge flow rates or the sampling interval (for constant volume samples) is proportional to the flow rates over the time period used to produce the composite.

6. The "monthly average" temperature means the arithmetic mean of temperature measurements made on an hourlyfbasis, or the mean value plot of the record of a continuous automated temperature recording instrument, either during any calendar month, or during the operating month if flows are of shorter duration.
7. The "daily maximum" temperature means the highest temperature i observed during a 24-hour period or during the operating day if flows are of shorter duration.

8. The "minimum" value means the lowest value measured for at least a 24-hour period.
9. "Bypass" means the intentional diversion of wastes from any portion of a treatment facility.
10. "Upset" means-an exceptional incident in which there is unintentional and temporary noncompliance with technology-based

' permit effluent limitations because of factors beyond the reasonable control of the permittee.

11. "Estimated" flow means a calculated volume or discharge rate
  • which is based on a technical evaluation of the sources - '

contributing to the discharge including, but not limited to pump capabilities, water meters and batch discharge volumes.

12. "Measured" flow means any method of liquid volume measurement. -

the accuracy of which has been previously demonstrated in engineering practice, or for which a relationship to absolute volume has been obtained.

13. "Recorded" flow, pH, temperature, etc., means any method of providing a permanent, continuous record including, but rot limited to, circular and strip charts.

C. T0XIC POLLUTANT REPORTING The permittee shall notify the Department as soon as it is known or suspected that any toxic pollutants which are not specifically limited by this permit have been discharged at levels which will exceed the notification levels specified in 40 CFR Part 122.42(a).

D. REMOVED SUBSTANCES

1. Within 90 days of the effective date of this permit, unless already submitted with the application, the permittee shall submit to DHMH on a form provided, the following information:
a. Locate, on a suitable map, all areas used for the disposal of any Removed Substances as defined by II. General Conditions B.7; '
b. Tre physical, chemical and biological characteristics, as appropriate, and quantities of any Removed Substances handled, and the method of disposal;
c. If disposal is handled by other than the permittee.  !

2. Prior to the use of new or additional disposal areas er contractors or subcontractors the permittee shall notify, in writing DHMH.

E. WASTEWATER OPERATOR CERTIFICATION

Within six months from the date of issuance of this permit, the permittee's facility shall be operated by an industrial wastewater operator duly certified by the Maryland Board of Waterworks and Waste Systems Operators. At no time during the effect of this permit shall the treatment facilities be operated

  • for more than six months without a certified operator. l l

ANALYTICAL LABORATORY Within 30 days of the effective date of this permit the permittee shall submit to the Department the name and address of the analytical laboratory (including the permittee's own labe-atory) which is used to perform the monitoring required by this permit.

If the laboratory used changes during the life of the permit, then the permittee shall notify the Department of the new laboratory _ withii.

G. OTHER REQUIREMENTS

1. The permittee shall be permitted to discharge water used to backwash

. intake screens. Inert material from intake screen backwash shall be l collected and disposed of in a manner to prevent it from entering waters of the State.

2. The permittee shall be permitted to discharge storm water from a '

point source located on the south end of plant property along ,

Barge Haul Road. l

3. The limitations and conditions specified in this permit shall not be interpreted or construed to supersede or replace any inconsistent i specific mandatory operating limitation imposed by the Nuclear Regulatory '

Commission upon the permittee.

Within 30 days of each occurrence, the permittee shall submit a written report discussing the cause of the  ;

problem, plant reaction, and precautions to be taken to avoid similiar impingements. .I i

5. The permittee shall maintain a minimum flow or take such steps as '

to prevent embayment mortalities when the plant is not in service.

6. There shall be no discharge of biphenyl transformer fluids to the waters of the State. I I

A. 'NONITORING AND REPORTING

l. Recresentative Samolino. .

Samples and measurements taken as required herein shell be:

taken at such times as to be representative of the quantity and quality of the discharges during.the specified monitoring periods.

2. Reporting-Monitoring Results Submitted Ouarterly Monitoring results obtained during the previous quarter shall be sunnarized on a Discharge Monitoring Report Form (EPA No. 3320-1 or T-40). For each constituent monitored at a frequency of once per month or less,-the results obtained during the reporting quarter shall be sunnarized on a single report form for each' quarter. More frequently ponitored constituents shall be reported on a separate form for each calendar month of the reporting quarter. Results shall be submitted to the DHMH postmarked no later than the 28th day of the month following '

the end of tne reporting period. Reporting periods shall end on the last day of the following menths: March.

June, September and December. The first reporting period ends June 30, 1987.

The reports shall be submitted to:

c. The dates the analyses were performed;
d. The person (s) who performed the analyses;
e. The ' analytical techniques or methods used; and
f. The results of all required analyses.
5. Monitoring Ecuioment Maintenance - '

The permittee shall periodically calibrate and perform main-tenance procedures on all monitoring and analytical instru-mentation to insure accuracy of measurements. -

6. Additional Monitoring by Permittee

~

If the permittee monitors any pollutant at the locations designated herein more frequently than required by this permit, using approved analytical methods as specified above, the results of such monitoring, including the increased frequency shall be included in the calculation and reporting of the values required in the Discharge Monitoring Report form (EPA Nol 3320-1 or T-40).

7. Records Retention All records and information resulting from the monitoring activi-ties required by this permit, including all . records of analyses performed, calibration and maintenance of instrumentation, and original recordings from continuous monitoring instrumentation shall be retained for a minimum of three (3) years. This period shall be automatically extended during the course of litigation, or when requested by DRMH.

B. MANAGEMENT REQUIREMENTS

  • pollutants shall be reported by the permittee by submission of a new application or, if such changes will not violate the effluent limitations specified in this permit, by notice to DHMH. Following such notice, the pemit Ny be modified by CHPJi to specify and limit any pollutants not previously limited.
2. Nonconcliance with Effluent Limitations If for any reason the permittee does not comply with or will be unable to comply with any daily maximum or daily minimum effluent limitation specified in this pemit, the pemittee shall notify the Enforesent Program by telephone at 301-225-5700 within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> of becoming aware of the noncompliance. Within five days the permittee shall provide DHMH with the following information in writing:
a. A description of the noncomplying discharge '

c. Anticipated time the cendition of noncompliance is expet ted to continue or if such condition has been corrected, the duration of the period of noncompliance; .
d. Steps taken by the pemittee to reduce and eli-minate the nonccmplying discharge; *
e. Steps to be taken by the permittee to prevent '

recurrence of the condition of noncompliance;

f. A description of the accelerated or additional I monitoring by the pemittee to determine the nature and impact of the noncomplying discharge. -

6. _Pemit Modification, Suscension Revocation After notice and opportunity for a' hearing this pemit may be modified, suspended, or revoke,d and reissued in whele or in part during its tem for causes including, but not limi'.ed to, the following:
a. Violation of any tems or conditions of this permit;
b. Obtaining this permit by misrepresentation or failure to disclose fully all relevant facts; or
c. A change in any conditian that requires either a temporary or pemanent reduction or elimination of the authorized discharge; or
d. Information that the pemitted discharge poses a
  • threat to human health or welfare.
7. Texic Pollutants Not withstanding II-C-D and above, if a Toxic Effluent I Standard or Prohibition (including any schedule of compliance specified in such Toxic Effluent Standard or Prohibitten) is established by the U.S. Environmental Protection Agency or pursuant to Section 9-314 of the Health-Environmental Article, Annotated Code of Marvland for a toxic pollutant which is present in the discharges authorized herein and such standard is more stringent than any limitations upon such polluta.nt in this -permit, this pemit sha'.i be ,

ravoked and reissued or modified in accordance with the l

9. Civil and Criminal Liab411t'v .

Except as provided in permit conditions on "bypassing", "upset" and "power failure", nothing ia this per !' thall be construed to preclude the institution of any legal action nor relieve the permittee from civil or criminal responsibilities and/or pentities for non-ccmpliance with Title 9 of the Health-Environ = ental Article, Annotated Cede of Marv1and or any Federal, Local, or other State law or regulation.

10. Procerty Richtt/Cecoliance with other Recuirements The issuance $of this permit' does not convey any property rights in either real or personal property, or any exclusive privileges nor does it authnri2s any injury to private property or any invasion of personal richts, nor any infringement of Federal, State or local laws or regulations
11. Severa$.ility The provisions of this permit are severable. If any provisions of this permit shall be' held invalid for any reason, the remaining provisions shall rsmain in full force and effect.

If the application of any provision of this permit to any circumstance is held ir. valid, its application to other circum .

stances shall not be affected. .

12. Waterway Construction and obstruction This permit does not authorize the construction or placing of physical structures, facilities or debris, or the ur.dertaking of related cctivities in any waters of the State.
13. Cocoliance with Water Pollution Abatement Statutes The permittee shall ccmply at all times with the provistens of Health-Environmental Article. Title 7, Subtitle 2 and Title 9 S'.'beitle 3 of the Annotated Code of Maryland and the Clean Water Act, 33 U.S.C. 11251 eji sec. ,

NPDES PERMIT On September 5, 1974 the Administrator of the U.S. Environmental Protection Agency appi'oved.the proposal submitted by the State of Maryland for the operation of a permit program for discharges into navigable waters pursuant to Section 402 of the Clean Water Act. 33 U.S.C. Section 1342.

Pursuant to the aforementioned approval, this Disenarge Permit is both a State of Maryland Discharge Permit and a NPDES Permit.

This permit and the authorization to discharge shall expire at j midnight on the expiration date'of the permit. Permittee shall not  ;
