PROPOSED LEGISLATION ON DETERMINING THE EFFECTS  ;;

0F PAST OCEAN DUMPIhG 0F RADI0 ACTIVE WASTES

~ Per your. request, we have reviewed the subject legislation, H.R. 8119 and our comments are presented below:

1. As drafted the bill would direct the Secretary of Coraaerce to undertake a study of all ocean disposal of radioactive wastes rather

-that being limited to those radioactive wastes disposed of by the '

United States.

2. "High-level" waste in anmended Section 203(f)(2)(B) of H.R. 8119 should be defined as containing reprocessed radioactive wastes from chemical reprocessing plants or irradiated spent fuel assembl.ies to be consistent with the.present Commission definition and that contained in a number of other proposed bills on nuclear waste management.
3. 'The Department of Energy also should be included in Section 203(f)(2)

4. Given the very.high visibility and interest in ocean disposal, we believe that tiRC should be positive towards this legislation and indicate that NRC would be more than pleased to assist the Secretary

'in his review of old AEC . licensing records. It should be noted that Sheldon Trubatch (OGC) also called earlier this morning to obtain our views on H.R. 8119. He indicated that the Chairman had expressed interest in whether IRC should have any consultation role with the Secretary of Comerce in making a detennination as to the effects of past ocean disposal. Our initial response was that EPA has had regulatory responsibility for ocean disposal since 1972 and tiRC
