Dear Mr. Elliott:

This will confirm our telephone conversation today regarding the remaining issue of an adequate backup hospital for onsite emergency preparedness at the Limerick Generating Station in accordance with the remand instructions nf ALAB-819.

Based upon your review of the draft procedures for handling and treatment of a contaminated and injured person transported from the Limerick plant to Montgomery Hospital, you stated to me that Limerick Ecology Action (" LEA") does not wish to take the. deposition of Dr. Roger E. Linnemann, as previously scheduled for January 3, 1986 in Philadelphia.

You also stated that, based on this review, LEA desires to withdraw its contention regarding the adequacy of a backup hospital, and that LEA has no objection to the draft procedures you reviewed for Montgomery Hospital. You said that you would prepare a draft stipulation for review by the parties, which you will furnish me by close of business Thursday. After the parties have reviewed and executed a final version of the stipulation we will, of course, submit it to the Licensing Board for its approval.

Inasmuch as the record is complete as to the same procedures at Pottstown Memorial Medical Center ("PMMC"), I suggest that the stipulation generally refer to the offer by Philadelphia Electric Company and acceptance by PMMC as a general basis for similar actions by Montgomery Hospital in

I have contacted NRC, FEMA and PEMA counsel and advised them that the deposition has been cancelled. I have further advised them as to the status of this matter and the anticipated draft stipulation.
