Dear Mr. Chainnan:

This letter concerns the written testimony that the Nuclear Regulatory Comission presented at the Subcomittee's November 14, 1985 hearing.

Referring to the Commission's proposed rule to require conversion of non-power reactors to low enriched uranium fuel (LEU), the testimony states: "If Federal funds are provided for university reactors but not for comercial non-power licensees, then a majority of the Comission believes that the rule should require the commercial licensees to convert to LEU notwithstanding the lack of Federal funds."

When the Commission appeared before the Subcommittee on November 14, three Comissioners supported this statement. At that time, the Comission's directions to the staff concerning this matter were not yet final and had not been issued. These directions have now been issued; however, as explained below, they do not include the statement from the Comission's testimony.

Upon further review of the background information on the impact of the rule, Comissioner Zech, who had supported the statement, found that he was unable to continue to support a position that the rule should require the comercial non-power licensees to convert to LEU notwithstanding a lack of conversion funding assistance. Comissioner Zech does not oppose conversion funding assistance, however, and if it becomes available he believes that conversion should be required for commercial non-power reactors as well as for university reactors.

Comissioner Asselstine and I continue to support the original testimony.

In addition, I agree with the majority that supports Federal funding for all conversions. However, Commissioner Asselstine favors Federal funding only for conversion of university reactors.

If no Federal funds are provided for any conversions I also support the majority's position that no conversions should be required. 'Comissioner Asselstine and I intend to attach our separate views to the Federal Register notice on the final rule.
