NRC INSPECTION REPORT NOS. 50-373/97006 & 50-374/97006,
NOTICE OF VIOLATION, AND EXERCISE OF ENFORCEMENT DISCRETION
Dear Mr. Subalusky:
On May 9,1997, the NRC completed an inspection at your LaSalle facility. Inspection exit
meetings to discuss the results of the inspection were conducted on May 16 and
May 30,1997. The enclosed report presents the results of that inspection.
During this seven-week inspection period, your staff's performance was characterized by
continued instances of plant personnel failing to follow procedures. Although there
appears to be a recent decrease in the overall rate of personnel errors, the procedure
adherence issues identified during this inspection period indicate that some plant personnel
still do not fully understand procedural requirements or place sufficient emphasis on
management's expectations for procedure compliance. Your staff's corrective actions in
this area to date have not been fully effective. In addition, the use of incorrect engineering
assumptions in an operability determination for a core standby cooling system ventilation
panel mounting configuration and in determining the acceptability of an impaired fire
barrier, indicate that corrective actions in response to the lack of engineering rigor and
thoroughness that was exhibited during the June 1996, service water event have not yet
been fully effective.

Based on the results of this inspection, the NRC has determined that four violations of
NRC requirements occurred. The circumstances surrounding these violations are described
in detailin the enclosed inspection report. The first violation, which is cited in the
enclosed Notice of Violation (Notice), involves three examples of plant personnel failing to
follow procedures. This violation is of concern because it demonstrates that continued
attention is needed to address the previously identified human perfurmance deficiencies at
LaSalle County Station.
The second violation involves several senior reactor operators and a reactor operator
performing licensed duties with inactive licenses due to your staff's mis-interpretation of
what constitutes " performing the functions of an operator or senior operator" in
maintaining an active license. The third violation pertains to a failure to meet Technical

instances in which operators with inactive licenses were on-shift. These two licensee-

identified and corrected violations are being treated as Non-Cited Violations, consistent
l
with Section Vll.B.1, " Licensee-ldentified Severity Level IV Violations," of the " General
l
l
Statement of Policy and Procedures for NRC Enforcement Actions" (Enforcement Policy),
l
l
l
The fourth violatien involves either the failure to incorporate the actual mounting
configuration of safety-related ventilation panels into design drawings and generate
i
supporting seismic calculations during original plant construction, or the inability to retrieve
the associated design documents. With respect to this ' violation, the NRC is exercising
i
enforcement discretion'and not issuing a Notice of Violation because the criteria specified
in Section Vll.B.2, " Violations identified During Extended Shutdowns or Work Stoppages,"
of the NRC Enforcement Policy are satisfied. Specifically, the NRC identified violation is

based upon activities of the licensee prior to the events leading to the licensee's decision
in December 1996 to enter into an extended shutdown to address long-standing
performance issues, it would not be categorized at Severity Level I, it was not willful, and
l
enforcement action is not considered necessary to achieve remedial action. In addition,
actions specified in Confirmatory Action Letter Rlli-96-0088 effectively prevent the

licensee from starting up LaSalle County Station without implicit NRC approval.

You are required to respond to this letter and should follow the instructions specified in the
enclosed Notice when preparing your response. The NRC will use your response, in part,
i
to determine whether further enforcement action is necessary to ensure compliance with
NRC regulatory requirements.

its enclosures, and your response will be placed in the NRC Public Document Room (PDR).
