j 2. Enforcement Conference

An Enforcement Conference was held at the NRC Region III office on

' July 18, 1988, to discuss an apparent violation contained in !nspection

Reports No. 50-456/88020(DRSS); 50-457/88020(DRSS), which was transmitted

to the licensee by letter dated July 1, 1988. The attendees of the

conference are identified in Paragraph 1 of this report.

The purpose of the conference was to: 1) discuss the violation, in

relation to its significance, cause, and the licensee's corrective

actions; 2) determine whether there were any aggravating or mitigating

circumstances; and 3) obtain other information which would help determine

the appropriate enforcement action.

NRC representatives presented the apparent violation as stated in the

above noted report and the circumstances surrounding the violation. It

was stated that the_ violation resulted from two separate occasions when

NRC personnel observed a security officer inattentive to duty while

. compensating for an unlocked and unalarmed vital area portal.

K The licensee addressed their perspective regarding the violation. The

licensee agreed with the factual information presented in the NRC report

regarding the events and licensee corrective measures. The 1icensee

further stated that the demeanor of the security guards and their

observed level of ina.ttentiveness to duty was not at the performance level

that is expected and required of all security guards and that each event

was an isolated case which involved only the security guard whose level of

performance at the time of observation was not consistent with, or

indicative of, the level of training provided to all security guards

concerning alertness and attentiveness to duty. The licensee stated that

neither event represented a failure to maintain positive access control to

a vital area in that, in one case, the guard became aware of the

resident's presence on his own accord without outside stimulus to alert

him. Also, the position of the guard (blocking the walkway) was such that

he would become alert if an attempt was made to bypass the guard.

Regarding the second event, the licensee's position was that the resident

inspector would have been challenged had he attempted to enter the vital

area in an unauthorized manner. In concluding, senior licensee management

emphasized their continuing commitment to support the security program.

NRC representatives stated that all information regarding the violation

will be evaluated to determine the appropriate level of enforcement action

regcrding the inattentiveness to duty issues.
