SECY-84-223 - Final Rule Change to 10 CFR Part 50, Appendix E,
- Frequency of Emergency Preparedness Exercises The Commission by a vote of 5-0,* approved for publication a final amendment to 10 CFR Part 50, Appendix E governing the frequency of emergency planning, as modified in the attached page 16.
The Commission also directed the staff to prepare, and submit for Commission review and approval, guidance for making the determination on whether a remedial exercise is required and if so, the extent of State and local participation.

- Section 201 of the Energy Reorganization Act, 42 U.S.C.
Sec. 5841, pr.ovides that action of the Commission shall be determined by a " majority vote of the members present."
Commissioner Gilinsky was not present when this item was affirmed, but had previously indicated that he would approve.
Had Commissioner Gilinsky been present, he would.have affirmed his prior vote.
Accordingly, the formal vote of the Commission was 4-0 in favor of the decision.

4 Remedial exercises will be required if the emergency plan is not satisf actorily tested during the biennial exercise, such that FEMA-san net-g4ve-HRG NRC, in consultation with FEMA, cannot find reasonable assurance that adequate protective measures can De taKen in the event of a radiological emergency. The extent of State and local participation in remedial exercises shewid must be sufficient to show whether that appropriate corrective measures san-be have been taken regarding tne elements of the plan not properly testeo in tne previous exercise.

Any weaknesses or deficiencies that are identified shail be corrected.
