Dear Dr. Vierima:

This letter is in response to your letter of May 23, 1988 in which you inquired about NRC's plans for dealing with Governor's certifications submitted by states to meet the January 1, 1990 milestone of the Low. Level Radioactive Wasts' Policy Amendments Act of 1985 (the Act). As you correctly note, the Act directs NRC to transmit any such certification to Congress and publish it in the Federal Register.

We appreciate the need expressed in your letter for timely guidance to states and corpacts.

In that regard, we are planning to issue a letter to all Governors presenting the, staff's position on the issue.

Presently, we envision that certifications submitted should include the following information:

Estimates of the volume of waste and who will generate it after Decerber 31, 1992; j

The proposed storage, disposal or management actions af ter Decerber 31, 1994; The logistics of the proposed action in terms of organizational responsibility, tining and scheduling; and l

Indication that proposed actions are within existing legal authorities and are consistent with NRC or Agreerent State regulations and/cr policies.

Finally, as you are aware, the subject of Governor's certifications is on the dgenda for discussion at the low level Waste Forum reeting in Toronto on l
