SUBJECT:

Enforcement Action - Tripler Anny Medical Center, Honolulu, Hawaii License No. 53-00458-05 Enclosed is a proposed Notice of Violation which we plan to send to the subject licensee.

This matter was discussed with Jack Metzger on August 28, 1981.

The single violation involves a situation where the interlocks designed to limit rotation of the teletherapy gantry and swivelling of the teletherapy head were inoperable.

This condition would pennit the teletherapy beam to be directed into unrestricted areas. We considered both Severity II and Severity III, but actually decided the violation should be classed as a Severity IV (Supplement VII), Example 1. "violations that reduce the margin of safety", for the following reasons:

1.

As far as we could detennine, the beam never was directed into the unrestricted area.

2.

Since nonnal treatment modes do not require direction of the beam into the unrestricted area, it is unlikely that the beam would be directed into the unrestricted area.

3.

The beam was directed into the unrestricted area under controlled conditions, and the inspector measured a maximum dose rate of 14 mr/hr on the surface an outside wall and about 6 mr/hr 18 inches from the wall.

4 Because of the short periods of time that the beam is actually on, it is unlikely that anyone could receive a significant total dose.

5.

The interlocks were deactivated by authorized individuals during regular (and perhaps NRC required) maintenance.

There are no NRC requirements for routine checks of these interlock, l

The licensee took immediate and effective corrective action.

Unless you have a serious objection, we plan to issue this Notice of Violation on Friday, September 4, 1981.

Appendix A NOTICE OF VIOLATI0ft Department of the Amy License No. 53-00458-05 Tripler Army Medical Center HST - RP Tripler AMC, Hawaii 96859 As a result of the inspection conducted on July 24 and 27,1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violation was identified:

A.

License Condition 25 states that the licensee shall possess and use licensed material in accordance with statements, representations, and procedures contained in letter with enclosures dated August 25, 1977 signed by William C. Long, Captain, MSC; letter with enclosures dated April 5,1978, signed by Vandy L. Miller, Colonel, MSC; and application dated November 1,1979, signed by John R. Mohn, Major, MSC.

Item 1(c) of the "Radiation Survey Report" submitted with the letter dated April 5,1978 states, "at teletherapy head swivel I

angles of greater than 50, the "BEAM ON" condition is allowed at 0

gantry rotation angles less than 1110 CCW and 114 CW,gndis precluded at gantry rotation angles of 1110 CCW and 114 CW or greater."

Contrary to these requirements, the "beam on" condition was allowed at teletherapy head and gantry rotation angles in excess of the operational limits. The "beam on" condition was allowed with a 0 CW.

gantry rotation of 125 CCW and a head swivel angle of 25 The "beam on" condition was also allowed with a gantry rotation of 2450 CW and a head swivel angle of 50 This is a Severity level IV Violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201. Tripler Anny Medical Center is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results achieved; (2) corrective step (s which will be taken to avoid further3) the date whe items of noncompliance; and achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or af finnation.

Consideration may be given to extending your response time for good cause shown.
