D EiR uss-c UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION NEDN BEFORE THE ATOMIC St.FETY AND LICEiiSING BOA [0cNTE1I l"U E F t. N.w In the Matter of 1

Docket Nos. 50-443 OL PUBLIC SERVICE COMPANY OF 50-444 OL NEWHAMP5 HIRE,etal.

Off-site Emergency Planning (Seabrook Station, Units 1 and 2)

NRC STAFF RESPONSE TO MASSACHUSETTS ATTORNEY GENERAL'S OFFFER PROOF AND MOTION FOR RECONSIDERATION On July 6,1988 the Mass AG filed "Offer Of Proof and Motion For Reconsideration."

In that filing the Mass AG seeks to overturn the Licensing Board's decision cf June 6, 1988 denying leave to file its rebuttal testimony.

The Staff opposes the Mass AG's motion on the grounds that it is untimely and fails to present matters which could not have been anticipated by the Mass AG in its filing of direct testimony.

Further, some of these matters have already been addressed in the direct testimony of Dr. Goble and the Mas's AG's latest filing essentially seeks a second chance to augment that earlier testimony.

The Board's prior order denying j

leave for filing of Mass AG's rebuttal testimony was correct and reconsideration is unwarranted.

i Respectfully submitted,
