RESPONSE OF THE MASSACHUSETTS ATTORNEY GENERAL TO APPLICANTS' MOTION FOR PROTECTIVE ORDER In response to the Applicants' Motion for Protective Order, the Massachusetts Attorney General ("Mass AG") states as follows:

1.

The Mass AG has agreed with the Applicants to the terms and conditions of the Affidavit of Non-Disclosure filed with the Applicants' Motion for Protective Order.

2.

The decision of the Mass AG to agree to the terms and conditions of the Affidavit is made in light of the discovery cut off date of August 1, 1988 on the Notification Contention, and to facilitate more expeditious access to the critical information which is the subject of the motion.

Although-the Mass AG recognizes the earlier decisions of the Off-Site Board pertaining to similar matters, the Mass AG in'no way agrees'with those decisions.

Specifically, neither the alleged privacy interests of affiliates of the utility nor_the alleged commercial interests of the Applicants, as described;in the Board's Memorandum and' Order, are bases for

-issuing a protective order.

In addition, the Mass AG continues to object to the unfounded and speculative-assertions of the Applicants that certain members of "the community" could or would cause any potential witness to be intimidated.
