Counsel, you wanted to know how many times temporary we.ivers of compliance i

were issued of the type recently granted by the staff involving the Limerick and Peach Rottom facility licenses.

Advice on the legal permissibility of l

waivers of this type used in this situation was provided to you separately l

by the General Counsel in a memorandum dated March 10, 1988.

The temporary waiver of compliance granted for Limerick and Peach Pottom is i

the first waiver issued by the staff that was not issued in conjunction with an emergency licensing amendment.

Temporary waivers of compliance have been used by the NRR staff to grant relief from a technical specification limiting i

condition of operation while the staff is processing an emergency license amendtrent. This type of waiver is usually in effect after the appropriate findings have been made for only a few days until the amendment is processed and issued. The quidance in grantino such relief was issued in a nemorandum from H. R. Denton and J. M. Taylor to the Regional Administrators dated February 27, 1987, superseding the previous quidance issued on November 21, 1985.
