Dear Mr. Pate:

Thank you for your letter of September 4,1987 sharing your thoughts regarding the development of "codes of ethics" and "operating principles" for the nuclear power plant operators.

The professionalism of nuclear power plant operators is an ongoing concern of the Nuclear Regulatory Comission. The NRC staff believes that the Carolina Power and Light Company's code of ethics is well written and that it addresses most of the issues essential to operator professionalism. However, we would suggest that such a code also address the issue of fitness for duty, as included in the Guidelines.

It is important to emphasize operators' responsibilities in ensuring that they and their colleagues are always physically and mentally fit for duty.

Further, we would strongly suggest words to the effect that an individual operator will not tolerate incorrect conduct or actions by others who share the responsibility to operate the plant safely.

We endorse the concept of operator development and "ownership" of any code of ethics. To impose such a code without significant input from the operators would undoubtedly result in a minimum comitment on their part and would not truly adhere to the principles or professionalism. Therefore, we suggest that the Guidelines specifically encourage the development of the code of ethics by the operators rather than by utility r.anagement.
