Dear Sir:
On July 15, 1988, counsel for the NRC staff tentatively agreed to a stipulation with the State of Vermont (State) and Vermont Yankee Nuclear Power Corporation (Vermont Yankee) regarding the proposed amendment to Vermont Yankee's operating license noticed in 53 Fed. Reg. 22396 at 22,408 (June 15, 1988), pending approval by the NRC staff.
By the terms of the stipulation, the NRC staff would agree not to object on the grounds of timeliness if the State filed a petition for intervention concerning the proposed amendment by July 25, 1988, but would reserve the right to object to the petition on any other ground.
The stipulation's purpose is to allow the State and Vermont Yankee to pursue settlement negotiation during the week of July 18, 1988.
The NRC staff, having considered the matter, now agrees to the stipulation.
Please find enclosed a copy of the stipulation executed by the NRC staff.
