NRC STAFF RESPONSE TO APPLICANTS' MOTION FOR SCHEDULE The NRC Staff supports that part of the Applicants' Motion which suggests that the SPMC and Graded Exercise contentions 5e litigated on the same schedule. With the exception of a modification in the schedule to allow for prehearing conferences on both the SPMC and GE contentions, ,

Staff generally agrees with the time intervals suggested by Applicants.

The Staff suggests the following schedule be adopted by the Board.

August 2, 1988 FEMA Preliminary report of GE issues.

August 3-4, 1988 Prehearing conference on SPMC contentions August 15, 1988 Contentions on GE filed. (Based on August 2, 1988 issuance of FEMA report.)

August 22, 1988 Board Order ruling on SPMC contentions. Discovery on SPMC contentions opens.

August 25. 1988 Answers to GE contentions filed.

September 13-14, Prehearing Conference on GE contentions. Discovery 1988 of GE contentions open.

September 23, 1988 Discovery ends on all contentions.

November 7, 1988 Summary Disposition Motions due.

November 28, 1988 Summary Disposition Replies due.

December 23, 1988 Direct testimony filed by all parties.

January 10,1989 Evidentiary Hearings commence.

The Staff further suggests that the Board identify those proposed contentions on which its wishes to hear argument prior to the'prehearing conferences to allow parties to prepare for the conferences. The Staff recognizes that this schedule may be revised once GE contentions are filed and the Board determines which SPMC and GE contentions merit argument in the prehearing conferences.
