Dear Ms. Connor:

This letter responds to your February 11, 1988 appeal of this Agency's denial of documents identified on Appendix B of our January 21, 1988 response to F01A-87-783 and 87-858.

In response to your appeal, the denied naterial was again reviewed.

On the basis of this review, I affirTn the Agency's initial determination in this matter.

The withheld portions of document B-1 consist of draft letters prepared for the Comission's review and subsequent approval. As drafts, these documents are predecisional and do not reflect final Agency policy on the subject matter to which they pertain.

Consequently, the Agency's reliance on Exemption 5 to deny disclosure was entirely justified.

This letter represents final Agency action on your February 11, 1988 appeal. Judicial review of the Agency's action in this matter is available in Federal District Court in the district in which you reside, or have your principal place of business, or in the District of Columbia.
