SECY-88 Second Petition of the Commonwealth of Pennsylvania for a Hearing on Peach Bottom Nuclear Power Station; Letter from Governor Casey The Commission, by a 4-0* vote, approved an order responding to a January 22, 1988, petition to intervene from the Commonwealth of Pennsylvania.
The petition requesta a hearing with respect to the proposed issuance of amendments to licenses held by Philadelphia Electric Company (PECO) for operation of the Peach Bottom Atomic Power Station, Units 2 and 3.
The order refers the matter to the Chairman of Atomic Safety and Licensing Board Panel for appointment of a Licensing Board to consider whether the Commonwealth's petition to intervene should be granted in accordance with the Commission notice of opportunity for hearing and this order limiting the hearing to matters within the scope of the amendments under consideration.
Insofar as the petition requests a discretionary formal restart hearing on matters outside the scope of this proceeding, that request was denied in a separately addressed letter to Governor Casey.
Commissioner Rogers recused himself from participation in this matter before the Commission because of his prior association with the Public Service Enterprise Group which has a minority ownership interest in Peach Bottom, Units 2 and 3.
