Beaver Valley Power Station, Unit No. 2 Docket No. 50-412, License No. NPF-73 Pennsylvania Capital Stock Tax Exemption for Pollution Control Facilities Gentlemen:

The Pennsylvania Departr nt of Revenue permits an exclusion from the tax base for capital Stock Tax purposes for pollution control facilities.

The requirement is that such facilities be certified as "Pollution Control Facilitics" by the Department of Environmental Resources.

The Pennsylvania State Bureau of Radiation Protection has indicated that they are not responsible for certifying the radioactive liquid waste equipment since it is under the control of the Nuclear Regulatory Commission and that the Commission should be contacted for their approval.

We request your certification of our radioactive liquid waste equipment and piping as a water pollution control system necessary to comply with respective Beaver Valley Power Station liquid waste federal and state discharge permits.

Since Capital Stock Tax is a deduction on the 1987 Federal Income Tax Return which must be filed by September 15,

1988, the certification should be provided prior to August 31, 1988.

Enclosed for your information is an "Application and Notice of State Certification for Corporation Tax Benefits for Air and Water Pollution Control Devices".
