STIPULATION NOW COME the Stato of Vermont, Vermont Yankee Nuclear Power Corporation (Vermont Yankee), and the NRC staff, and stipulate as follows:
1.
On May 23, 1988, Vermont Yankee requested an amendment to operating license which would allow it to utilize GE 8X8EB fuel.
The amendment was noticed in the Federal Register, and an intervention deadline of July 15, 1988 was established.
2.
While Vermont Yankee and the State of Vermont have held discussions regarding the amendment, there are certain technical issues which remain unresolved.
3.
The parties are optimistic that further discussions which have been scheduled for the week of July 18, 1988 will result in resolution of the outstanding issues.
4.
It is in the best interest of all parties to avoid the time and expense associated with intervention at this time.
5.
In view of the above factors, the above named parties agree that Page 1

a.)
If the State of Vermont files a petition to intervene in this matter on or before July 25, 1988, Vermont Yankee and the NRC staff will not object to the petition on the ground that it is untimely; b.)
Vermont Yankee and the NRC staff reserve the right to raise any and all other objections to any petition to intervene filed by the State of Vermont.
6.
Separate copies of this stipulation may be executed in lieu of all parties executing a single original.
