WEEK ENDING MARCH 25, 1988 l NRC Meeting with IAEA Staff on US Implementation of International Safeguards On March 23, 1988, NMSS staff met with Messrs. Thortensen and Wredburg of the IAEA'S Department of Safeguards to discuss the current status of US implementa-tion of international safeguards, planned IAEA inspections, and experiences from past US and NRC licensee implementation of IAEA safeguards. Presently only one NRC licensee is subject to full scope IAEA safeguards (General Electric  !

l tives also discussed a seminar that is planned for May 1988, in Vienna, Austria, to infom the IAEA safeguards staff of the methods and the successful outcome of the physical inventory verification conducted in 1987 at the Westinghouse, .

Columbia, South Carolina fuel fabrication facility. The Westinghouse facility  !

was one of the largest fuel facilities under IAEA safeguards, and the recent  :

inventory verification represented a concerted and well coordinated IAEA, NRC l and licensee project. (As of January 1, 1988, the Westinghouse facility is no longer subject to full scope IAEA safeguards.)

Meeting with Maryland Officials on Peach Bottom William Russell, Region I Administrator, and Marie Miller, Regional State Liaison Officer, met on March 22, 1988 in Annapolis, Maryland, with senior State officials including Dr. Torrey Brown, Secretary of the Department of Natural Resources and Martin Walsh, Secretary of the  :

l Department of Environment. The meeting was requested by the Regional I

Administrator to brief the State on the status of the Peach Bottom facility and to discuss the NRC staff restart deliberation process.

Status of activities at the Calvert Cliffs facility was also discussed.

The State appreciated the discussion of the Peach Bottom issues and stated they would infonn Governor Schaefer that it was a position exchange.

_ Resolution of GSI !!.E.4.3 RES has coepleted resolution of GS! II.E.4.3, "Containment Integrity Check" and will forward it to the Executive Director for Operations shortly. This issue was identified in the TMI Action Plan (NUREG-0660), which proposed a require-ment for the perfomance of a feasibility study to evaluate the need and possi-ble methods for perfoming periodic tests or a continuous test to detect un- l known openings in the containment structure. After careful and extensive re-  !

view of operating experience, present methods of containment leak testing, po- l tential new methods for continuous leak testing and an analysis of the risks involved, we have concluded in our resolution that no new license requirements are necessary or are cost beneficial. It should also be pointed out that GSI II.E.4.3 deals with containment leakage during postulated (e.g., design basis) I accidents and does not address the issue of containmert integrity and associ-ated radiation consequences during severe accidents. This last issue is being addressed as part of implementing the Comission's policy on severe accidents and more specifically in the Individual Plant Examination (IPE) and Containment Perfomance Improvement Programs.

e OFFICE OF NUCLEAR REACTOR REGULATION ITEMS OF INTEREST Week Ending March 25, 1988 Catawba Units 1 and 2 This infomation updates highlights of March 10,14, and 17,1988 regarding the Unit 2 "A" train AFW pump suction swap-over to the service water system. At Catawba, AFW is normally supplied to the steam generators from 3 non-seismic sources (an upper surge tank, the condensate storage tank and the condenser hotwell). In the event of low suction pressure, switchover to the seismic source (nuclear service water) occur automatically, During the evening of March 16, and March 17 a.m. the licensee conducted about 20 tests involving various combinations of Unit 2 AFW pump starts and suction source configurations, including the initial conditions of the March 9 event during which only one of the two trains ("A") initiated swap-over. The test results shew that the low level (607.) in the upper surge tank, coupled with isolation of the condensate storage tank and auto start configuration, caused low suction pressure and the swapover of the suction to the service water system. The differences in sensor taps and time delays caused only one train

' ("A") to swap to service water.

After a review of the test results by the A!T, Region II and NRR, the licensee was given NRC concurrance to restart Unit 2 at 9:00 a.m. today (3/18/85t).

Conditions associated with this NRC concurrence are being documented by Region II in a letter to the licensee. -

NRR will followup on long-term corrective actions. Meetings are also planned regarding associated potentiel enforcement issues. The AIT is preparing a report on its findings.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Ending March 25, 1988 LOW-LEVEL WASTE MANAGEMENT Low-level Waste Meeting With Vermont Yankee Mr. Dean Weyman, a representative of Vennont Yankee, has requested a meeting with the NRC staff to explore the possibility of locating a low-level waste disposal facility at the Vermont Yankee plant site. Mr. Weyman indicated that Vennent Yankee was only interested in a low-level waste burial facility at this time and has not considered storage and/or disposal of low-level wastes in the contain-ment building after plant decomissioning. The meeting should be held in late March or early April depending on staff availability.

Sandia National Laboratories Performance Assessment Program Review NMSS and RES staff and management participated in a review of Sandia National Laboratories' (SNL) HLW Performance Assessment Program on March 15-16, 1988, in Albuquerque, New Mexico. The objectives of the review were to evaluate the ade-qJacy of SNL's program and to evaluate transfer of the HLW Perfonnance Assessment Program to NRC's Federally Funded Research and Development Center for the HLW program and to NRC's development of a performance assessment methodology for the LLW program.

HIGH-LEVEL WASTE MAPAGEMENT Results of Meeting with DOE on Seismic Monitoring Network in Yucca Mountain Vicinity From February 29 to March 2, members of the Operations and Technical Review Branches of the Division of High-level Waste Management, DOE and its contractor, the USGS, visited the seismic monitoring facilities in Golden, Colorado and typical field sites in Nevada. The purpose of the visit was to develop an understanding of the physical lay-out of the seismic monitoring network and nature of the day-to-day operations involved in the acquisition, processing, and publishing of the seismic data detected by the network. A second purpose of the visit was to develop an understanding of how the USGS quality assurance procedures are applied to this activity. The NRC stu f found that the seismic nonitoring facility and field sites were technically adequate for the purpose of monitoring the seismic activity in the vicinity of the proposed HLW reposi-tory at Yucca Mountain. However, some quality assurance procedures may need further consideration, particularly in the areas of computer code verification, field equipment calibration, and clarification of the data processing methods used to produce the annual report.

2 l Federal Register Notice on Anticipated and Unanticipated Processes and Events, 10CFR50 On February 28, 1988, the Division of High-level Waste Management released for public comment a Draft Generic Technical Position (GTP) titled, "Guidance for Deterinination of Anticipated Processes and Events and Unanticipated Processes and Events." The purpose of this Draft GTP is to provide guidance concerning the methodologies that the NRC staff proposes to use to evaluate processes and events which could occur after closure of a high-level waste repository.

This is being done so that these processes and events can be categorized into "anticipated" and "unanticipated" processes and events. This categorization is necessary as the engineered barrier and waste package must be designed assuming anticipated processes and events in order to meet the recuirements of 10 CFR 660.113. In addition, in order to conform to the applicable environ-mental standards as expected to be set forth in 40 CFR 191 and implemented in 10 CFR 560.112, both anticipated and unanticipated processes and events must be considered.

Transportation International Atomic Energey Agency Consultant Meeting on High Consequence /

Low Probability Accidents in Transport of Radioactive Material The meeting was convened in Vienna, Austria, March 15-18, 1988, with participants from Japan and the United States. The purpose of the meeting was to provide preliminary assessment and advice on the possible need for changes to the Agency's Regulations for Safe Transport of Radioactive Materials (Safety Series No. 6),

and to consider high consequence / low probability accidents in transport. inclu-ding air transport.

t 3 The consultants focused on: (1)plutoniumairtransportaccidentconsiderations; (2) the disparity between corresponding safety criteria in use by member states

and IAEA's regulations; and, (3) the philosophical and technical bases that are

! appropriate for transport safety regulation. The consultants reconenended that:

(1) the IAEA's safety regulations be modified (within a specified range of

options) to provide performance qualifications for air shipment of large cuantities of radioactive materials; (2) the basis for the modification se-1ected be documented, and (3) that an action plan describing procedures and corresponding timetables to accomplish the regulatory revision be developed.

On the advice of the Agency's Standing Advisory Group on the Safe Transport of Radioactive Materials (SAGSTRAM), the consultant's advice is to t'e considered by an Agency Technical Comittee at a meeting to be held in November 1988. J l

INDUSTRIAL AND MEDICAL NUCLEAR SAFETY )

Foster Wheeler Modular Vault Dry Store (MVDS) Design Topical Report. The MVDS consists of up to 5 vault modules, as described in the Topical Peport.

each with a capacity of 83 FWR or 150 BWR spent fuel assemblies.  !

l On March 22, 1988, NRC staff met with Nuclear Assurance Corporation (NAC) to discuss submittal of a Topical Report for a dry spent fuel storage cask design with allowance for burnup credit in its criticality design analysis. ,

NAC plans to submit this Topical Report in June 1988. The stainless steel and lead cask's capacity would be 31 Westinghouse PWR assemblies decayed 10 years or more.

l Nuclear Fuel Services, INC. (NM) Decomissioning of Holding Ponds ,

On March 18, 1988, representatives of NMSS and Region II met with Tennessee State Officials and NFS representatives in NFS's Erwin facility. The NFS representatives provided a status presentation of their ongoing character-ization studies of the liquid holding ponds. Under the current phase of the study, NFS plans to expand the existing groundwater monitoring program by drilling additional monitoring wells around the ponds and to analyze additional

sludge samples. The objectives of the study are to adequately characterize the site hydrology, to determine whether the pond sludges must be considered mixed waste, to aid in development of sludge treatment or processing technology, and

< to assess the possible impact of a proposed reroute of a creek named Banner Spring Branch (BSB). The reroute of BSB is recomended by the NFS consultant j

to decrease the potential of becoming contaminated by runoff during the pond decontamination operation. NFS plans to complete the pond characterization studies by December 1988, and a detailed pond decomissioning plan by March 1989.

Some exarples of issues related to the severe accident management research and strategies are: 1) negative consequences of injecting water into a degraded core, 2) core coolability under degraded conditions, 3) advantage / disadvantage of diverting water from the vessel to the containment, 4) effective strategies for preventing both short-term and long-term containment failure and 5) plant status indications which should be available to the operating staff during a severe accident. The panel members discussed evaluation criteria, format of the proposals, the length of period in which proposals should be accepted, potential funding it. vel and responsibilities of the panel members. It was agreed that Branch Chiefs would serve on the panel as advisors. The panel would consider results of evaluations and available funding, then make recomendations to the Division Director.

This guide endorses ANSI /ANS 8.9-1987, "Nuclear Criticality Safety Criteria for Steel-Pipe Intersections Containing Aqueous Solutions of Fissile Material."

Items of Interest Office for Analysis and Evaluation of Operational Data Week Ending March 25, 1958 Incident Response On March 21. the Incident Resonnse Branch (IRB) staff met with the Office of Administration and Resources Management to discuss future requirements in the l areas of telecemunications and computer managed information systems.

4 On March 22, the Director, AE00 and IRB staff provided a tour and a briefing of l the Operations Center to visiting Commonwealth Edison Company efficials. The utility discussed modifications to its corporate comand center and questioned  :

the staff on its experie' ices with the current design of the Operations Center.

On March 22, an IRB staff member attended a meeting of the Federal Radiological Preparedness Coordinating Comittee (FRPCC) subcommittee to discuss options for  ;

ensuring that all State and local agencies gain Federal Field Exercise experience.

On March 23, the Director AEOD, Division Directo?, DOA, and IRB staff attended

, a meeting of the FRPCC. A recorrendation was made to send letters to the White House on the need for compatibility of the FRERP with the Netior.31 System for g

Erergency Coordination and to the Environmental Protection Agency on modifications to the National Contingency Plan.

The FRPCC concurred in plans to conduct regional (FEMA region) workshops and tabletop exercises on the FRERP beginning late FY 88 or early FY 89 and holding ,

the next FFE in 1991.

. Diagnostic Evaluation and Incident Investigation The Diagnostic Evaluation and Incident Investigation Branch (DE!!B) has begun preparation of a proposed evaluation plan for the next diagnostic evaluation.

causes for performance differences between the selected plant and the other, relatively good prefonning nuclear station in the licensee's system.

On March 21, the DEIIB Chief and nembers of his staff met with metrbers of the

E00's technical and .'egional cperations support staffs to discuss EDO staff a comments and questions on the McGuire Diagnostic Evaluation Report and proposed 1 staff actions. Following the meeting the DE!!B staff initiated steps to
address the items which were discussed.

NRC Staff Meet Canadians at Fermi 11

> On Friday NRC staff met with a Canadian delegation which was touring the  !

Fenni 11 nuclear plant. The 13-nember Canadian team included members of

, the Canadian Parliament and representatives of federal and provincial authorities. The NRC staff present,which included representatives of HRR, Region !!!, OGC and GPA, responded to questions on regulatory issues j associated with Fermi II operations.

STATE, LOCAL AND INDIAN TRIBE PROGRAMS Meeting with Paryland Officials on Peach Bottom ,

William Russell, Region ! Administrator, and Marie Miller, Regional State Liaison Officer, met on March 22, 1988 in Annapolis, Maryland, with senior State officials including Dr. Torrey Brown Secretary of the Department of Natural Resources and Martin Walsh, Secretary of the i Department of Environment. The meeting was requested by the Regional Administrator to brief the State on the status of the Peach Bottom facility and to discuss the NRC staff restart deliberation process.

Status of activities at the Calvert Cliffs facility was also discussed.

The State appreciated the discussion of the Peach Bottom issues and stated they would inform Governor Schaefer that it was a positicn exchange.

j National Conference of State Legislatures The Energy Comittee of the National Conference of State Legislatures met to discuss NRC reorganization proposals on March 25, 1988 at the State-Federal Assembly in Crystal City, Virginia. The Committee held a 1 panel discussion with James Curtiss of the Senate Subcomittee on Nuclear j Regulation; Herbert Brown, Kirkpatrick and Lockhart; and Joe Kelliher of

! the Ararican Nuclear Energy Council to discuss NRC reorganizaton proposals. After the panel discussion, the Energy Comittee unanimously adopted a policy position which urges Congress to adopt legislation to replace the Comission with a single administrator. The Comittee also jl adopted policies cencerning standardizetion and high-level and low-level I

! On January 22, 1986 NRC issued guidance to States and Cor. pacts on the l availability of NRC regulatory assistance and the nature of such I

assistance. At this time, SLITP is providing further information j concerning the scope and extent, of technical assistance which can be

! expected from NRC. SLITP and the Division of Low-level Waste Management  ;

Approximately 10 Government agencies were represented at the Oxon Hill High School job fair and 60 companies were represented at the Gaithersburg and Upper Montgomery Chamber of Connerce job fair.

The action was based on violations including (1) excessive radiation levels inside an acid storage tank, an unrestricted area; ,

(2) performance of maintenance by approwlmately 27 individuals inside or near -

the tank without the scurces being in the locked and shielded position and '

without a radiation survey being performed prior to the work; (3) removal of *

the nuclear gauges from the tank, by unauthori
ed individuals while the gauges '

were in the unshielded position; and (4) failure to place the gauges, once '

removed, in a shielded storage container. (EA 87-175)

! Water Problem at White Filnt .

NRC learned that the drinking water at One White Flint North is apparently i contaminated, when a preliminary test ar.'anged by CSA indicated that the average lead content amounted to 410 parts per billion (ppb). The Environmental Protection Agency (EPA) has set the Federal drinking water standard threshold at 50 ppb, and is considering revising it to 20 ppb. j 1

When the Office of Consolidation was notified of the test results on March 21, '

i r arrangements were made immediately to shut off the water in all drinking fountains and coffee stations, and to provide bottled water in coolers located in the elevator lobbles throughout the building. Warning signs were posted at + entrances and in all restrooms.

i The source of the contamination is still uncertain, but EPA advises that elevated lead levels are not uncommon in new buildings. The levels may vary  ;

i widely for a variety of reasons, and it is possible that a thorough flushing of i the water system will remedy lead accumulation in the pipes. An additional

) test of the system was performed on March 25, and further tests will be t carried on during the next week, i

1. The Regional Administrator and De>uty Regional Administrator i conducted a Management Meeting at tie Georgia Institute of ,

Technology on March Pl. The purpose was to enchance l' comunications and better understand the licensee's future course of action.  !

2. On March 23, the Deputy Regional Administrator attended a meeting at the Corporate Office of the Florida Power & Light Company (FP&L) in which Enercon presented to FP&L conclusions and recom-mendations from their management assessment. These findings sill be documented in their mid April resort. The Enercon findings L were hard-hitting and appropriate, and tie recomendations appeared to be on target. FP&L corporate management appeared to be very receptive to both.
3. The Regional Administrator met with the newly appointed President f and Chief Executive Officer for Power, Allen J. Veesler, and selected members of his staff on March 23 to discuss nuclear '

operations at Florida Power Corporation.

4 On March 23, a Branch Chief from the Division of Radiation Safety f and Safeguards accorpanied Commissioner Carr and his Assistant  ;

on a tour of the Barnwell Low Level Radioactive Wastt Disposal ,

Facility, and on March 24, the Regional Administrator and a i Projects Section Chief accompanied Comissioner Carr on a tour of the Georgia Power Corpany's Hatch Nuclear Power Stations in Baxley, Georgia.  !

6. On March 24, the Deputy Director, Divisien of Reacter Projects I and a Projects Branch Chief attended a briefing in Headquarters of the Director, Office of Nuclear Reactor Regulation, on the status of plants in Project Directorate !!-3.

The Commission's order provided that, in the special circumstances  !

of this case, a stay would be granted until April 11, 1988, or  !

until the staff informs the Licensing Board that it has bee-advised by DOJ that DOJ has no objections to the commencemt of further proceedings, which ever occurs first. The order notes that no further delay will be granted.

The Cormission also understands that OGC, in consultation with I the EDO and the Boards, will examine means by which cases like Finlay Testing could be handled in the future. OGC should report to the Coraission on this matter.
