Pir . l.ando Zech, Chairman Nuclear Regulatory Commission 1717 11 Str eet , NW.

Washington, DC 20555 Dear Mr. Zecht this is a folIow-up to my letter of September 26. 1986 addressed to Mr. Pal 1adino. We have been hearing much Iately regarding local and state sovereignty regardi ng the Shorehani issue. Although I . ain not a 1awyer, I have spent some t i me bludying the problem and it appears to me that the arguments are fal1acions, especial 1y in 1Ight of the hastory of this issue.

Cnnfronted with the reality of our dependence upon foreign eii anil the proportion of that dependency belonging to ._ong Island, Article 1, bection 8 of the Constitution sht.u l d apply; this is becked by the fact that Congress c i e e. t M the IJRC for the purpose of regulating the nticlear ener gy industry with responsi bi l i ty for public health and soi et y. In l i gli t. of the potential for limited "emergencies" "L any noc! ear fscility affecting an inter-state area, It follo.s that r esporrs i bi l i t y rests with your agency; the coop +t ation sought from 1ocal and state offscials 1s therr responsibility, not their option to use as a political weapon. I l<. Cuiioch v. f1aryIand (l819) should appty ta this situalion.

Nna t ot Daniel Patrick Moynthan was quoted by the media, re. the demi se of "Westway", something to the effect that we have come to the sorry stage of history where we are no ionyer launch ng geeat publai_ works, but in fact have become edept at finding ways to prevent t heni. He was so right. I hope lhet the adminitration's ideological position on States rights will not tmc ome a set of blinders preventing responsii>!e ac t i on in this matter.

This .ounty cannot absorb the psychological and f iinanc i s t t u s- t at the loss of Shoreham and, I belteve, thi s nation shoold not have to absorb the 1oss of such a potential f os safe, eleso ener gy.
