Dear Chairman Jensch:

The Staff received on November 21, 1978 a telegram from you advising us that "unless miswering briefs respecting the position to intervene by the Indian tribes are received from Applicants and the Staff on or bcfore November 20, it will be assumed that the Applicants and Staff have waived their request (as shown in letter of October 12, 1989 from Thomsen) to file briefs within three weeks of Indian supporting brief." This letter is to confirm that Mr. Treby, Staff counsel received a telephone call from your secretary on Friday, Nov-ember 17,1978 advising him (1) that the telegram had been sent :,nd (2) what was the text of the telegram. Mr. Treby informed Mr. Swanson, Staff counsel assigned to the task of preparing the Staff brief of the communicatien and Mr. Swanson subsequently telephoned Mr. Jensch's secretary on November 17, 1978 and advised her ' hat the Staff had not received Mr. Busch's submission until October 31,197. .nd, applying the schedule for submissions contained in Mr. Thomsen's letter of October 12, 1978, he had calculated that the last day foi filing for the Staff's brief was November- 21, 1978. The Staff filed its response on November 21, 1978.
