Dear Mr. Chairman:
During the course of the hearing on October 20, 1987, you raised an issue concerning how the NRC considers reopening closed enforcement actions under our enforcement policy. Your particular concern was that it appeared to you that enforcement actions would be reopened to decrease penalties, but would not be reopened to increase penalties as a result of new information. At that hearing I committed to you that the Commission would review that aspect of the enforcement policy.
I am pleased to inform you that the Commission completed action today on a revision to the enforcement policy which clarifies that the NRC would consider the merits of reopening a closed case for the purposes of both increasing and decreasing the enforcement sanction. This clarification should remove any doubt as to the Commission's intention to respond appropriately when new information, which has implications for previously closed enforcement actions, comes to the Commission's attention.
The staff will be preparing a Federal Register Notice with the clarifications to the enforcement poTicy. I Eelieve the Commission's action fully addresses the concerns you expressed in the October 20, 1987 hearing.
