p?A -lsft l Federal Register Notice NUCLEAR REGULATORY COMMISSION ADVISORY COMMITTEE ON REACTOR SAFEGUARDS Procedures for Meetings BACKGROUND Procedures to be followed with respect to meetings conducted by the Nuclear Regulatory Commission's Advisory Committee on Reactor Safeguards, which were published October 31,1977 (42 FR 56972) are renewed by this notice. Ib changes have been made, and they are reprinted for the infor-mation and <onvenience of interested persons. These procedures are set forth in order that they may be incorporated by reference in future individual neeting notices.

(ACRS)

The Advisory Committee on Reactor Safeguards /is an independent group established by Congress to review and report on each application for a con-struction petmit and on each application for an operating license for a reactor facility and on certain other nuclear safety matters. The Commit-tee's reports become a part of the public record. Although ACRS meetings 1

are ordinarily open to the public and provide for oral or written statements I from members of the public to be considered as a part of the Committee's information gathering procedure, they are not adjudicatory hearings such as are conducted by the Nuclear Regulatory Commission's Atomic Safety and Licens-ing Board as part of the Commission's licensing process. ACRS reviews do not normally encompass matters pertaining to environmental impacts other than those pertaining to radiological safety. ACRS full Committee, Subcommittee, l

l and Working Group meetings are conducted in accordance with sections 29 and 182b. of the Atomic Energy Act (42 U.S.C. 2039, 2232b.) .

GENERAL RULES PEGARDING ACRS MEETfINGS An agenda is published in the Federal Register for each meeting.

Practical considerations may dictate some alterations in the agenda. The Chairman of the Committee, Subcommittee or Working Group which is meeting is empowered to conduct the meeting in a manner that, in his judgment, will ,

facilitate the orderly conduct of business, including provisions to carry

' over an incomplete session from one day to-the next.

With respect to public participation in ACRS meetings, the following rements shall apply:

(a)

Persons wishing to submit written statements regarding the agenda items may do so by providing a readily reproducible copy at the beginning of  :

the meeting. When meetings are held at locations other than Washington, D.C.,

i reproduction facilities are usually not available. Accordingly, 15 additional copies should be provided for use at such meetings. Comments should be limited ,

to safety related areas within the Committee's purview.

Persons desiring to mail written comments may do so by sending a readily {

reproducible copy addressed to the Designated Federal Employee specified in the Federal Register notice for the individual meeting in care of the ACRS, NRC, ,

Washington, D.C. 20555. Comments postmarked no later than one calendar week prior to a meeting will normally be received in time for reproduction, distribution and. consideration at the meeting.

(b) Persons desiring to make an oral statement at the meeting should make a request to do so prior to the beginning of the meeting, identifying the topics and desired presentation time so that appropriate arrangements can be made. The Committee, Subcommittee or Working Group will receive oral statements on topics relevant to its purview at an appropriate time chosen by the Chairman.

(c) Further infor_aation regarding topics to be discussed, whether a meeting has been cancelled or rescheduled, the Chairman's ruling on requests for the opportunity to present oral statements and the time allotted therefor can be obtained by a prepaid telephone call, on the working day prior to the meeting, to the Office of the Executive Director of the Committee (telephone 202-634-3265, ATIN: the Designated Federal Employee specified in the Federal Ibgister Notice for the meeting) between 8:15 a.m. and 5:00 p.m., Washington, D.C. time.

(d) Questions r.my be asked only by ACRS Members, Consultants and Staff.

(e) The use of still, ration picture, and television cameras, the physical installation and presence of which will not interfere with the conduct of the meeting, will be permitted both before and after the meeting and during any recess. The use of such equipment will be allowed while the meeting is in session at the discretion of the Chairman to a degree that is

( not disruptive to the meei.ing. Wnen use of such equipment is permitted, appropriate measures will be taken to protect proprietary or privileged information which may be in documents, folders, etc., being used during the meeting. Recordings will be permitted only during those sessions of the meeting when a transcript is being kept.

. l (f) A copy of the transcript of the open portions of the meeting where factual information is presented will be available at the NRC Public Document Room,1717 H Street, N.W. , Washington, D.C. 20555, for inspection within one week following the meeting. A copy of the minutes of the neeting will be available at the same location on or before three months following the meet-ing. Copies may be obtained upon payment of appropriate charges.

Copies of the above-mentioned minutes and transcript will also be placed in the NRC Local Public Document Room, when appropriate, on the same time schedule. The location of the Public Document Room will be indicated in these cases in the individual Federal Register notice for the treting.

SPECIAL PR7/ISICUS WrIEN PROPRIETARY SESSIONS ARE 'IO BE HELD If it is necessary to hold closed sessions for the purpose of discussing matters involving proprietary information, persons with agreements or orders permitting access to such information may attend those portions of ACRS meet-ings where this material is being discussed upon confirmation that such agree-ments are effective and relate to the material being discussed.

The Executive Director of the ACRS should be informed of such a agreement at least three working days prior to the meeting so that the agreement can be confirmed and a determination can be made regarding the applicability of the agreement to the material that will be discussed during the meeting. The minimum information provided should include information regarding the date j

of the agreement, the scope of material included in the agreement, the project or projects involved, and the names and titles of the persons signing the agreement. Mditional information may be requested to identify the specific agreenent involved. A copy of the executed agreement should be provided to the Designated Federal Employee prior to the beginning of the meeting.
