Dear Mr. Chairman:

I am responding to your letter of February 5, 1988, concerning I hope I the reorganization of the Office of Investigations.

can clarify what the Commission has done and the reasons for its decision.

As we stated in our letter of January 29, 1988, our actions to date have been designed to initiate implementation of the directive contained in the Statement of Managers accompanying the Continuin'g Resolution for FY 1988.

That language directed us to consolidate our inspection and examination organizations under the Executive Director for Operations.

It is our belief that the conferees intended the Commission to comply with their directive, and we have taken steps to do so.

We recognize that various other proposals on this subject are pending Congressional action, but they have yet to be enacted, and the Commission is not in a position to predict when such action will occur.

Should the Congress adopt a different course in the future, we will comply with whatever legislative solution ultimately emerges.

In your letter of February 5, 1988, you reiterated the earlier request of Chairmen Udall, Dingell, Gejdenson, and yourself that we take no action to consolidate 01 and the EDO offices until your Committees had an adequate opportunity to review the impact of the reorganization.

The Office of Investigations continues to exist as a unit and to function as it did before, except that it now administratively reports to the Office of the Executive Director for Operations instead of directly to the Commission.

This is a measure intended to comply with the spirit of the directive in the Statement of Managers while we study the best means of implementing that directive.

We have established an 01 Organization Review Group for this purpose, which we expect will complete its work in the near future.

Until the Review Group's report is complete and the Commission has reviewed that report, we will not make further organizational changes to consolidate OI and the EDO offices.

l i One of the goals of the Review Group is to determine whether a more efficient and cost effective utilization of staff resources is possible, while continuing to assure the independence and quality of the investigative revfew functions.

To the extent that costs are identified, they will be included in the Review Group's report.

What we can say is that the cost of implementing the change in the reporting status of 01 has been negligible.

They are principally the costs associated with notifying the NRC staff, the Congress, and the public.

Costs associated with the operation of the Review Group are also expected to be minimal, probably less than the cost of one half of one FTE.

We will be pleased to provide a copy of the Review Group's report when it is completed.

With regard to your ren'iest for documents, we interpreted your request literally t.

Our letter of January.29 enclosed all of the documents related to the action we took to ii,'tiate implementation of that di ective.

I have asked our Congressiona! Affairs staff to provide you by separate cover with copies of background documents dating from January 1, 1982 relating to the organization of 01.

I reiterate, however, that these documents were not considered by the Commission in taking the action described in our January 29, 1988 letter.

Our Congressional Affairs staff is also arranging with your staff for a briefing on this issue, as you requested.
