IMPOSITION OF CIVIL PENALTY IN COMANCHE PEAK (ATCHISON) CASE Over the past few weeks you have expressed reservations to me about proceeding with the Atchison case. To allow me to make a determination'on whether to recocinend imposition of the penalty, I would appreciate a legal analysis of ,

the facts in the case regarding whether the firing of Atchison constituted '

a violation of Appendix B, including a discussion of whether we would be likely to be able to prove in a hearing that a violation occurred. Please provide this analysis as soon as possible as we would like to resolve this remaining Comanche Peak enforcement action by the end of April.

Keppler, Director of Special Projects to Texas Utilities Generating Company, to the attention of Mr- William G. Counsil, Executive Vice President, regarding why Mr. Keppler "iotermined af ter consultation with the Deputy Executive Director for 1.igional Operations, that the violation set forth in EA 83-64 should be withurawn and that violations B & C of 86-63 occured as stated."

This request includes all agency records as defined in 10 C.F.R. 9.3a(b) and the NRC Manual, Appendix 0211, Parts 1.A.2 and A.3 (approved October 6,

1980) whether they currently exist in the NRC offical, "working" invsstigative or other files, or at any other location, including private '

residences.
