Dear Mr. Miller:

The Staff has reviewed the County's Interrogatories dated March 3,1988 addressed to the NRC Staff regarding the proposed EBS system for the Shoreham facility.

Discovery upon the NRC Staff requires that you comply with the requirements of 10 C.F.R. 59 2.720 and 2.744.

In its Memorandum and Order dated March 4,

1988 the Licensing Board dealt with an attempt to obtain discovery from the Staff.

The Licensing Board there urged the Staff to provide information to the Intervenors where such information was readily available, in keeping with the spirit of the Board's Order, I am informing you that the Staff does not now contemplate calling witnesses for the remand hearing on the EBS issue, if our views change I will promptly inform you.

This answers your interrogatories 1-6.

As we informed you in our January 22, 1988 Response to your First Set of Interrogatories dated January 9, 1988, Rosmary T.

Hogan monitors the Shoreham offsite emergency plans for the Staff.

Miss Hogan has had no communication with LILCO ccncerning the EBS proposal in Revision 9 to the LILCO plan.

We do not concede that this information is relevant.

In regard to your interrogatory number 8, LILCO provided the Staff on January 26, 1988 with a copy of its Prompt Notification System Report pursuant to FEMA Rep-10.

A copy has been provided to you and a copy is in the Commission's Public Document Room.

Although you have not proceeded pursuant to 10 C.F.R. 5 2.720, or attempted to meet the conditions set out in that regulation for discovery from the Staff, I believe tliis letter provides you with the information you seek.
