APPLICANTS' ANSWER AND OBJECTION TO THE MOTION OF THE STATE OF RHODE ISLAND FOR ENTRY OF AN ORDER REQUIRING FURTHER INFORMATION AND REQUEST FOR PROTECTIVE ORDER IN CONNECTION THEREWITH

1. Under date of October 13, 1978, the State of Rhode Island and Providence Plantations (State) served a " Motion for Entry of an Order Requiring Further Information" (Motion).
2. The State's Motion requests an order directing New

-England Power Company (NEP) to supply certain voluminous '

information with respect to two alternate sites "as i at of its Environmental Report".

3 Although not denominated as such, the Motion amounts ,

to a request for discovery in the form of a set of interroga-tories combined with a' set of requests for production, although ,

obviously in no form recognized by the NRC's Rules of Practice.

4 The Motion is improper and the order requested should be denied for each and all of the reasons set out in Paragraphs 5 thrcugh 7 below.

5. The Motion is.in direct violation of this Board's

" Order Concerning Motions to Suspend Proceedings and Staff Review and Commencement of Discovery". New England Power Co.

(NEP, Units 1 and 2), LBP-78-9, 7 NRC 271, 294 (Feb. 21, 1978).

1 6.- The request, if granted, would require the detailed l type study by the applicants (and the Staff) of an alternate I i

site which was specifically held by the NRC not to be required  ;

i because ". . . the costs of that approach could not conscionably  !

be imposed on private applicants and their ratepayers". P.S. Co.

of N.H. (Seabrook Station, Units 1 & 2), CLI-77-8, 5 NRC 503, 529.(1977), affirmed sub nom. New England Coalition on Nuclear Pollution v. NRC, F.2d (1st'Cir. 1978).

7. This Board is.without authority to direct an applicant to include information.in its environmental report. The only sanction for an inadequate environmental report is a refusal by the Staff to issue a Draft Environmental Statement. See I 1
