BOARD MEMORANDUM AND ORDER (Setting Hearing and Discovery Schedule)

After consideration of the parties' recomendations concerning hearing schedule and discovery motions on the remaining emergency planning issues,1 the Board sets forth below changes in discovery requirements as well as schedule requirements up to and including commencement of hearings. On the four issues remaining--school bus drivers, emergency broadcast system, hospital evacuation and

- realism--the hearings will be consolidated and the issues considered consecutively. A one week recess prior to litigating the realism issues will be provided in the schedule.

The Board's decision herein is based on the discreteness of the issues to be resolved and the time periods that have been available for their consideration, the responsibilities of the parties in preparing for other related procedures including the 25% power motion, and the necessity for properly managing discovery in an already lengthy proceeding. All pending motions on hearing or discovery schedules not specifically referred to herein have been considered and are granted or denied in accordance with the Board's decision here.
