Dear Mr. Hinson:

Thank you for your letters of February 23 and April 21, 1988, in response to our letters dated January 25 and March 24, 1988. We have reviewed your reply and find it responsive to the concerns raised in our Notice of Noncon-formance. We will review the implementation of your corrective actions during a future inspection to determine that full compliance has been achieved and will be maintained. -

My staff has also reviewed your independent evaluation of the allegation aspects a.id your individual evaluation of the nonconformances effect on the applicable hardware certificates.of conformance. Your implementation of the third party recommendations resulting from these reviews will be vertfied during a future NRC inspection.

The engineering rationale and critique methodologies that were used by your consultants appear to be appropriate. However, in your reply you did not discuss the number of qualification packages prepared by Nutherm to date. Therefore, we cannot draw a conclusion as to the adequacy of the sample reviewed.

This specific area will be reviewed during a Sture inspection.

As discussed between your Mr. Eckert and J. J. Petrosino of my staff during telephone calls on May 16-17, 1988, one deviation was noted in your attachment example No. 2; consequently, some hardware testing deviations noted in your correspondence may be reportable to the end user as a minimum so that they may cause a 10 CFR Part 21 potentially reportable evaluation to be performed.

We have no further questions or require any additional NI response at this time and will review your corrective action, preventive measures, and allegation aspect reviews during a future inspection.
