PROPOSED If! POSITION OF CIVIL PENALTY - $175,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of One Hundred Seventy-Five Thousand Dollars ($175,000) will be issued on or about February 22, 1988 to Omaha Public Power District. This action is based on two events in which water from the Fire Protection System entered the Instrument Air System rendering one Emergency Diesel Generator inoperable with the potential for disabling the second. In addition to the inoperability of the diesel generator the Notice of Violation cites, among other areas, the licensee's inadequate evaluation of the modification that allowed the two systems to be connected, the failure to report the water intrusion events, and the licensee's inadequate corrective actions.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice February 22, 1988 Telephone Notification of Licensee February 22, 1988 The State of Nebraska will be notified.

The licensee has thirty days from the date of the Notice in which to respond. l Fo11cwing NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
