Dear Mr. Hoyle:

As you know, the Citizens Awareness Network (CAN) and the Nuclear Information and Resource Service (NIRS) have provided the Commissioners with a 10 CFR 2.206 petition and amendment in November and December of 1996.

On December 17, 1996, at the NRC Millstone-Restart Public Meeting in East Lyme, CT, Mr. Phil McKee of the NRC stated publicly that the NRC might not be able to act on the portions of the petition which apply to NRC staff.

The Commissioners should be aware that CAN and NIRS sent a copy of the original petition to the Inspector General.

We believe that this action should have triggered the Inspector General's review of the petition for portions which would require action by his office.

Our position is that where the Commission or its staff cannot act on the petition and amendment as filed, to i

the extent that we have not done so, the Commission should turn all outstanding enforcement matters over to the appropriate officials both "in house" (i.e.,

the Inspector General) and "out of house" (i.e., the Department of Justice).

letter, we also note that we have not yet received any written acknowledgement of the receipt of either the petition or amendment from,the commission, the EDO, the Inspector General, or any agen'cf official.
