3 SUPPORTING STATEMENT, NRC FORM 396 CERTIFICATE OF MEDICAL EXAMINATION BY FACILITY LICENSEE (OMBClearanceNo. 3150-0024)
A.
JUSTIFICATION.
(1) Need for the Collections of Information Currently, the medical requirements of 10 CFR 55, "Operator's l
Licenses," requires an applicant to be examined by a licensed medical practitioner who will use guidance provided by ANSI /ANS 3.4-1983 as endorsed by NRC Regulatory Guide 1.134. The licensed medical practitioner submits his/her diagnostic report to the facility licensee. The facility licensee, based on the data provided, certifies on NRC Form 396 whether or not the applicant is healthy enough to prevent operational errors endangering public healthandsafety(10CFR655.23(a),and55.57(a)(6)].
In cases where the applicant for an operator's license or renewal does not meet the medical requirements or after recovery from a l
disabling condition, the facility licensee shall submit supporting medical evidence for review by the NRC consultant examining physician. The facility licensee must retain a copy of NRC Form I
396 and other documentation as a record while the employee continues in this capacity or a new medical examination has been conducted (10CFR55.27). The NRC and the consultant physician will review such evidence and decide if a conditional license or reinstatement from the disability shall be approved.
(2) Agency Use of Information The NRC uses the information as part of the basis for determining the fitness of an individual for licensing as a Reactor Operator or Senior Reactor Operator.

(3) Reduction of Burden Through Information Technology There is no legal obstacle to the use of information technology.
Moreover, NRC encourages its use.
(4) Duplication with Other Collections of Inforsation This information does not duplicate nor overlap other information collections made by the NRC or other goverreent agencies.
(5) Use of Similar Information This information is available only from facility licensees for each applicant for an operator license, new and renewal.
(6) Burden on Small Business This information coi. action does not involve any small businesses.
(7) Consequences of 1.ess Frequent Collection Information is to be provided with request for issuance of a license, renewal of a license or for notification of disability.
No required frequency of reporting is imposed for this information.
(8) Variation from OMB Guidelines This request does not vary from OMB guidelit.es.
(9) Consultations Outside the NRC There have been no formal consultations outside the NRC regarding this form.

(11) Sensitive Questions The facility licensee must certify that an applicant for an NRC operators license meets safeguards requirements for unescorted access to vital areas of a nuclear power plant. This certification i
requires a facility review of the applicants criminal history, if-any.
(12) Estimated Annualized Cost to the Federal Government Estimate of annual cost to the Federal Government includes:
NRC Consultant Examining Physician - 25 days x $160 = $4,000 Initial and final review - 1000 x.2 hrs = 200 hrs x $60 = $12,000 The Total annual cost to the government is $16,000.
The estimate of labor cost is based on the average number of applications received for the last 3 years.
(13) Estimate of Industry Burden and Costs (a)ReportingRequirements Approximately 1000 new and renewal applicant certifications are expected to be completed by facility licensees annually.
