BROWNS FERRY NUCLEAR PLANT UNITS 1, 2, AND 3 - REQUEST FOR RELIEF FROM ASME CODE SECTION XI, SUBSECTION IWE (TAC NOS. M97988, M97989, AND M97990)

Dear Mr. Kingsley:

On February'13, 1997, the Tennessee Valley Authority (TVA) requested relief from certain American Society of Mechanical Engineers (ASME) Code requirements delineated in a change to 10 CFR 50.55a dated August 8, 1996 (61 FR 41303) for the Browns Ferry Nuclear Plant (BFN) Units 1, 2, and 3. Specifically, TVA requested relief from full compliance with repair and replacement activities in accordance with ASME Section XI, 1992 Edition with the 1992 Addenda for Class MC (metal containment) components.

Based on the review of the licensee's relief request, the staff ccacludes that the immediate implementation of the requirements of the 1992 Edition of the ASME Code for repair and replacement activities, as required by 10 CFR 50.55a, will result in hardship for the licensee. The staff also finds that the use of the 1989 Edition of the ASME Code and the associated quality assurance requirements, as supplemented by the site specific quality assurance program developed by the licensee, provides an acceptable level of safety and quality.

Accordingly, the licensee's relief request for delayed implementation of 10 CFR 50.55a is authorized, pursuant to 10 CFR 50.55a(a)(3)(i), until October 24, 1997.
