COMEXM-97-002 - WARD VALLEY I agree in principle with option 2, modified as follows. Staff should prepare a letter for the Chairman's signature to Secretary Babbitt informing him of NRC's intent to become a " commenting agency" on the SEIS. The letter should specifically note that NRC's interests in the Ward Valley matter are focussed on protection of the public health and safety. The letter should also note that a DOI " Fact Sheet" has come to NRC's attention that contains significant errors of fact. Staff's comments can be contained in an attachment to the letter.
Finally, the letter should state a caveat that there are no formal arrangements with DOI which permit the NRC to review for and comment on the technical accuracy of DOI documents relating to LLW and Ward Valley. Therefore, the absence of NRC comments on other DOI documents should not be interpreted to mean that NRC considers them to be technically accurate.
