June 9, 2020 ALL AGREEMENT AND NON-AGREEMENT STATES STATE LIAISON OFFICERS ALL FEDERALLY RECOGNIZED INDIAN TRIBES NOTICE OF CORRECTION TO REQUEST FOR COMMENT NOTICE: PROPOSED RULE FOR EMERGENCY PREPAREDNESS FOR SMALL MODULAR REACTORS AND OTHER NEW TECHNOLOGIES AND CHANGE TO PUBLIC MEETING DATE (STC-20-043)
Purpose:
To provide notice of (1) the publication of the Federal Register notice (FRN),
Emergency Preparedness for Small Modular Reactors and Other New Technologies, that corrects the definition of Non-power production or utilization facility in the FRN enclosed with STC-20-041, Notice of Request for Comment: Proposed Rule for Emergency Preparedness for Small Modular Reactors and Other New Technologies, and (2) a change in the date for the public meeting to June 24, 2020.
Background:
On May 12, 2020, the NRC published the proposed rule, "Emergency Preparedness for Small Modular Reactors and Other New Technologies" (85 FR 28436). On May 13, 2020, the NRC provided (1) a copy of the proposed rule FRN with STC-20-041, Notice of Request for Comment: Proposed Rule for Emergency Preparedness for Small Modular Reactors and Other New Technologies (ADAMS Accession No. ML20066K668) and (2) notice of a tentative date for the public meeting.
Discussion: Enclosed with this letter is the FRN providing corrections to the proposed rule.
This FRN was published on May 29, 2020, and posted on the Federal e-rulemaking portal http://www.regulations.gov under Docket No. NRC-2015-0225. This FRN makes a correction to the definition Non-power production or utilization facility. This FRN can also be accessed at: https://www.govinfo.gov/content/pkg/FR-2020-05-29/pdf/2020-11228.pdf.

The public meeting discussed in STC-20-041 is now tentatively scheduled for June 24, 2020.

This rulemaking would add a new subpart (10 CFR 50.160, Emergency preparedness for small modular reactors, non-light-water reactors, and non-power production or utilization facilities) to the regulations that provide for alternate emergency preparedness requirements for small modular reactors (SMR) and certain non-power production or utilization facilities (e.g., medical isotope production facilities licensed under the regulations at Title 10 Code of Federal Regulations (10 CFR) Part 50, Domestic Licensing of Production and Utilization Facilities).
