Dear Mr. Arthur:
i This is to advise you that we agree that DOE may pursue construction
)
]L activities at the Tuba City UMTRAP site without prejudice to NRC's future conditional concurrence of the Remedial Action Plan (RAP).
As you are aware, we are nearing completion of our review of your proposed RAP and l
are presently preparing our evaluation report.
In summary, the issues i
1 that remain to be resolved prior to concurrence in the RAP are in the j
i areas of ground water, actual soil tett results from selected borrow t
areas, successful completion of the test plot and test results of rock l
proposed to be used for erosion protection.
With the exceptien of ground l
g water, we believe that the basic design proposed in the RAP will meet the l
1 required standards, but may require some minor adjustments upon receipt r
J of the test results.
I.
For ground water, the issue is that final ground-water protection standards have not been established by the Environmental Protection l
i Agency.
Until these standards are in place, a final plan for compliance l
cannot be approved.
However, we do not consider that the proposed i
j construction activities would adversely affect any future actions tha'

may be required to comply with the standards.
There remains a remote I
possibility that the final standards could result in some revision to the I
i Remedial Action Plan, but that is not considered likely, based on the J
draft standards, i
Accordingly, it is our opinion that the construction contemplated, based I
on the bid packages we have received, will not prejudice our anticipated i
conditional concurrence.,
We will require that the issues noted will i
be resolved before actual construction would reach critical points, l
e.g., there will be time available to permit NRC review of the i
