In accordance with Section 3016 of the Resource Conservation and Recovery Act, which requires that Federal agencies provide the U.S. Environmental Protection Agency with an inventory of hazardous waste that is stored. treated, or disposed of at facilities currently, or previously, owned by the Federal agency, the U.S. Nuclear Pegulatory Commission staff has reviewed NRC operations for 1996 and 1997 and has determined that:

NRC owned or operated facilities have not stored. treated, or disposea of hazardous waste during this time period; or.

2.

The amount of hazardous waste that has been stored, treated, or disposed of at NRC owned or operated facilities during this time period is such that the NRC owned or operated facilities are classified as conditionally exempt small cuantity generators.

Staff of the Federal Facility Inventory Hotline informed NRC staff that Federal facilities that have not stored. treated, or disposed of hazardous waste during the 1996/1997 time period, or are classified as conditionally exempt small quantity generators, are nnt required to complete the Inventory of Federal Hazardous Waste Facilities form that was forwarded to our offices on April 28. 1997.

Dear Ms. Jackson:

' Section 3016 of the Resource Conservation and Recovery Act (RCRA) requires all Federal agencies to compile, publish, and submit to the U.S. Environmental Protection Agency (EPA) an inventory of all facilities they currently own or operate, or have previously owned or operated, at which hazardous waste is stored, treated, or disposed of, or was disposed of at any -

l time. The statute specifies that this inventory be submitted every two years.' EPA's Office of

~ Solid Waste conducted the initial inventory in 1986, and subsequently in 1988,1990,1992, and 1994. In 1996, responsibility for conducting the inventory was transferred to EPA's Federal

]

Facilities Enforcement Office (FFEO), within the Office of Enforcement and Compliance Assurance. Since taking over responsibility, FFEO has finalized some outstanding issues regarding the 1994 inventory, and are now initiating the 1996 inventory. The 1996 inventory E

must be completed and submitted to EPA on July 28,1997. The purpose of this letteris to t request your participation in this Congressionally mandated program.

The 1996 inventory consists of two q'uestionnairee the "1_996 Inventory of Federal Hazardous Waste Activities at Currently Owned or Operated Federal Facilities," and "1996 Inventory of Federal Hazardous Waste Activities at Formerly Owned or Operated Federal Facilities (9FFs)." (Copies of each questionnaire are enclosed.) The first question I.e is aimed at those facilities which are currently owned or' operated by a Federal agency, and at'which hazardous waste is now being stored, treated 6r dispo, sed'of, or was disposed of at any time in the

' past. The second questionnaire is aimed at identifying those facilities which were formerly owned or operated by a Federal agency and at which hazardous waste was disposed before or during the time ofits Federal ownership or duringlits Federal operation.

b As in previous years, EPA has taken several measures in an effort to facilitate your mponse. First, EPA has pre-printed the 1996 questionnaire with the facility-specific g.stmation that your Agency provided in its 1994 inventory. The tasks remaining for your 1 Agency are to review the pre-printed 1996 inventory forms to ensure that the 1994 information is accurate, to make any necessary updates and corrections, and to complete questionnaires for any new entries into the inventory.. All questionnaires should be reviewed and completed by the iperson who is most familiar with the facilities identified in the inventory.

Second, EPA has established the Federal Facility Inventory Hotline, which is staffed by people familiar with all aspects of the inventory, and who are able to answer any questions. The toll free hotline number is 1-888-219-0522. If you have any general policy questions, your staff may contact Ms. Augusta Wills of the Federal Facilities Enforcement Office at 202-564-2468.

Third, if you prefer to submit the 1996 inventory information electronically, computer software is available upon request. Please contact the Hotline so we can prepare a diskette containing your agency's 1994 electronic files. The diskettes and instructions will be distributed during the interagency training, mentioned below. Electronic submittals will be due to EPA (90 days from date of this letter).

Finally, EFA has scheduled a half-day interagency training to provide an overview of the 1996 inventory, conduct a computer software demonstration, and answer questions pertaining to the inventory. The training will be held on May 21,1997, at 9:00 a.m. Your staffis likely to already be aware of this training session. If they have not yet done so, please have them call the Hotline to register and obtain further information. Although there is plenty of space available,it will be helpful for us to know how many people pirn to attend so that we can prepare the appropriate number of training materials. EPA will have the complete set of the 1996 pre-printed inventory questionnaires, detailed instructions, and a computer disk (if requested), available for each agency attending the training. We believe that this approach may accelerate the process by ensuring that the appropriate designated staff person (s) receives the forms. If a member of your staff is not able to attend the training, we will be happy to deliver these materials to your environmental designee upon request.
