REQUEST FOR PERMISSION FOR THE NUCLEAR REGULATORY COMMISSION (NRC)

TO CONDUCT A RADIOLOGICAL CONTAMINATION SURVEY TO PERMIT THE RELEASE FOR UNRESTRICTED USE OF THE FORMER LIONEL PLANT IN HILLSIDE, NJ

Dear Mr. Rosenthal:

This refers to the former Lionel Plant at 28 Sager Place in Hillside, New Jersey which your company currently owns. A portion of this property was used by Lionel Electronics Inc. under Atomic Energy Commission (AEC), the i

predecessor agency to the Nuclear Regulatory Commission, License No.

29-09446-01 from 1963 until the company entered bankruptcy in 1967.

Lionel used a variety of sealed sources as well as several long-lived radioactive materials in loose form at this facility.

The materials were used for laboratory research and development, the calibration of radiation detectors and the manufacture of voltage regulators.

The AEC and NRC records for this license were reviewed as part of an NRC program to ensure that facilities, where activities were authorized by AEC and NRC licenses that have been terminated, are suitable for release for unrestricted use in accordance with current NRC guidelines.

As part of this program, our contractor, Oak Ridge National Laboratory (ORNL), reviewed each terminated license file and scored it according to a system designed to identify facilities that require additional review by the NRC staff.

In general, files that indicate that radioactive material may have been used at particular facilities, but which do not include adequate final survey records for those facilities, are identified for additional review.

The review by ORNL identified License No. 29-09446-01 as a file describing a site that requires additional review.

The NRC Region I staff reviewed this file and determined that additional review was necessary since there is no final radiological survey of the former Lionel Plant and there exists the potential for radioactive contamination to remain there.

There is also no formal release of the facility for unrestricted use by the AEC or NRC, although records do show that Lionel dispositioned all radioactive material they possessed in early 1968.

the original Lionel Corporation (i.e. Lionel Trains Inc.).

Furthermore, the portion of the Lionel Corporation which survived the 1967 bankruptcy proceeding apparently went out of business several years ago.

However, we we're able to reach an individual within Lionel Trains Inc. who previously worked in the former Lionel Plant and who was able to describe the areas of the plant where radioactive material was used. The areas he described (i.e.

the second floor of the plant facing Sager Place and the former vault on the first floor) represent a small fraction of the floor area of the plant.

We request permission to perform a radiological survey of the plant to determine whether it meets our current criteria.

The survey will consist of an examination of the areas of the plant described above with radiation detection instruments.

In addition, smears of various surfaces will be taken to identify loose radioactive contamination and analyzed in our NRC Region I Office in King of Prussia, PA.

We will also take radiation readings and contamination smears in scattered areas around the remainder of the former Lionel Plant to confirm that radioactive contamination does not exist in other areas of the plant.

The survey would, most likely, take 1-2 days and involve two people.

If necessary, the survey will be done on off-hours to minimize the disruption to your tenants.

We would prefer to perform this survey in the near future if at all possible rather than wait until December as you suggested.

Upon completion of the survey and analysis of the smear samples, we will either issue a formal, written release of the facility for unrestricted use or, in the unlikely event that radioactive contamination is found, discuss what remedial actions would be required to obtain such a release.

You will receive a written report and an explanation of the survey results.

Upon receiving approval from your company to proceed, we will work with you to resolve the date, time and other logistics.
