Dear Mr. Liparulo:
By ktter dated June 20, 1997, Southern Nuclear Operating Company submitted Westinghouse Owners Group technical reports WCAP-12271, Revision 1,
"Wastinghouse Revised Thermal Design Procedure Instrument Uncertainty Methodology for Alabama Power Farley Nuclear Plant Units 1 and 2 (Uprating to 2785 MWT NSSS Power)," for NRC review and approval.
By your application dated June 16, 1997 (CAW-97-1119), and affidavit dated June 16, 1997, executed by Henry A. Sepp, Westinghouse Electric Corporation, you requested that the technical reports be withheld from public disclosure pursuant to 10 CFR 2.790.
A copy of Westinghouse's nonproprietary version was also submitted (WCAP-12272, Revision 1, Non-Proprietary Class 3) for placement in the NRC's Public Document Room.
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
1.
The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by eny of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.
2.
The information used by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similcr product.
i We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of Westinghouse's statements, have determined that the submitted information sought to be withheld contains proprietary commercial information.
