-I am writing:in response to the National Mining Association's. (NMA) letter  !

dated July.30; 1996. .which outlined some suggested revisions to the U.S. t

' Nuclear Regulatory Commission's final'" Staff Technical Position on Alternate Concentration Limits for Title II Uranium Mills" dated January, 1996. The i

.' letter suggested two revisions to the ACL guidance' document for the purposes of clarifying NRC's meaning with respect to the land transferred to the U.S. .i Department ~of Energy at license termination for the disposal of.11e.(2)- 1 byproduct material, . The staff reviewed the suggestions contained in your  :

~ letter and considered that NMA's suggested wording for page 7 of the guidance  ;

document would be appropriate: however, the staff considered that the suggested wording for page 8 may not be consistent with NRC's intended *

': meaning.

Asiyou are aware, the staff is presently developing and revising several 3 standard review )lans for Uranium Recovery activities, which will include i guidance for tec1nical reviews and. licensing actions at Title II Uranium  ;

' Mills. As part of.this effort, staff-is consolidating several previously 1 issued " staff technical positions." or " branch technical positions" into the l new standard review plans. These review plans, when published, will supersede the.previously issued technical positions. Once completed, the standard review plans will be issued as draft final documents and noticed in the-Federal Register for public review and comment. The lans will then be published as NUREG documents, after consideration of ublic comments.

-Because the ACL guidance document will be' incorporated into the Title II Uranium Mill standard review plan, the' staff will consider the suggestions detailed.in your letter and include ap3ropriate clarifications within the ACL portion of the review plan. NMA will lave an opportunity to review and 1 comment on these and other aspects.of the review plan during the puolic  ;
