DC 2C6 IA1602 May 4, 1994 Mr. Ivan Salin Chairman Nuclear Regulatory Commisolon 11555 Rockville Piko Rockvi110, MD 20852 Dear Mr. Selin I am writing in regard to the Nuclear Regulatory comminaion's (NRC) rocent decision to delay a final ruling on the March 31, 1994 Director'n Decision concerning a Section 2.206 petition filed by Robert Gary, Senior Researcher for the Pennsylvania Instituto for Clean Air (PICA).

It la my understanding that the h'RC decided to cuopond until May 5,1994 a decision to allow a comissioner* a Level Review of the July 10, 1992 petition filed by Mr. Gary concerning the of fsite emergency planning around tho Three Milo Island Nuclear Station (TMI).

Since it is my understanding that such postponamnnts are rare and occur only in the event that an investigation of a petitionor's concerns was not handled correctly or in the event that additional ovidence becomes available to investigators, I hopo the NRC will give this mattor opocial consideration.

I would also appreciate the NRC's informing me of the rationale for thu delay in the final reporting of the Director's Decision.
