RE: Reopened Contention 25.C Counsel for FEMA has nct yet received the transcript of the Conference Call conducted on January 19, 1988 concerning the discovery schedule in this matter. To the extent that I represented that FEMA would not present a witness on this contention, however defined, thac representation'is hereby modified by this letter. As stated in the response to Suffolk County Interrogatories filed tt's date, to the extent that Reopened Contention 25.C overlaps with FEMA's NRC January 27, 1988, requested review of Revision 9 of the SNPS Emergency Response Plan, FEMA upon completion of that review will sponsor FEMA witnesses on FEMA's findings. I hope this clarification is of assistance to the Board and Parties in this proceeding.

With respect to Lilco's January 25th Motion In Limine and Motion to Set a Hearing Schedule, FEMA defers to the position of NRC Staff and has no separate position.
