Final Systematic Assessment of Licensee Perfonnance (SALP)

Report No. 50-333/92-99

This letter forwards the final FitzPatrick SALP report (Enclosure 1) for the period

April 19,1992 through April 17, 1993. The initial SALP report was forwarded to you by

our July 7,1993 letter (Enclosure 2). Our evaluation was discussed with you and other

members of the New York Power Authority at a public SALP management meeting on

July 28,1993, at the FitzPatrick Training Center. A list of principal NRC and NYPA

attendees is provided in Enclosure 3.

The NRC has concluded that the FitzPatrick plant has been operated safely and that

performance has improved in several functional areas during this SALP period. The SALP

report notes improvements in the areas of Plant Operations, Maintenance / Surveillance, and

Safety Assessment / Quality Verification sufficient to warrant an increase to SALP Category 2

in these areas.

While we noted progress in the area of engineering and technical support, the NRC remains

concerned with the rate of improvement and mixed performance in this area. As related to

you in previous correspondence, our assessment noted several examples of weak evaluations

of emergent technical concerns, weaknesses in the initial evaluations and proposed

resolutions of Fire Protection and Safe Shutdown deficiencies, and inadequacies in related

engineering management oversight and control. Your commitment, as stated at the SALP

management meeting and in your written response dated August 16,1993 (Enclosure 4), to

provide strong management attention in this area to resolve these weaknesses and sustain

improvements, has been noted.

The NRC recognizes your commitment to continued improvements in performance and

resolution of weaknesses identified during the SALP process. However, neither remarks

during the July 28,1993 meeting, nor your written response would indicate reason to modify

the NRC staff's report; therefore, no changes have been made to the report as originally

forwarded to you.
