DIUM, AND* LOW ENRICHED URANIUM TO AUSTRIA (LICENSE APPLICATION NOS.
XSNM01725, XSNM01726, AND XSNM01727)
Purpose:
Commission review of proposed issuance of subject licenses to
-l Transnuclear, Inc.
Review Dates:
60-day period expires on February 13, 1981.
120-day period expires on April 14, 1981.
Discussion:
On September 8, 1980 Transnuclear, Inc.
submitted three applications for licenses to export enriched uranium to Austria.
The material, in the form of UF, will be shipped to 6
NUKEM in the FRG for ccnversion, and CERCA in France for fabrication of fuel elements for the ASTRA reactor in Austria.
l The material requested is as follows:

XSNM01725:
4.371 kilograms of uranium enriched to 93.3%,
containing 4.078 kilograms of U 235; 2.
XSNM01726:
33.0 kilograms of uranium enriched to 19.95%,
containing 6.584 kilograms of U-235; and 3.
XSNM01727:
3.735 kilograms of uranium enriched to 45.4%,
containing 1.704 kilograms of U-235.
ASTRA is a 12 megawatt reactor using MTR-type, high enriched uranium fuel.
It achieved criticality in September 1960, is owned ard operated by the Oesterreichische Studiengesellschaft-fuer Atomenergie, and is used for research in neutron physics, isotope production, and engineering tests.
The US has furnished HEU for thfs facility since it became operational.
In response to our request for views, the Executive Branch has (1) concluded that the requirements of the Atomic Energy Act of 1954, as amended, and P.L.95-242 have been met and that issuance of the proposed license would not be inimical to the common

defense and security of the United States; (2) confirmed that (Continued) the material will be subject to all the terms and conditions of the US-Austria Agreement for Cooperation and,during the time it is in the FRG and France, the US-EURATOM Additional Agreement for Cooperation; (3) noted that Austria and the members of EURATOM have adhered to the provisions of their Agreements for Cooperation with the United States; and (4) advised that there were no material changed circumstances since submission of its detailed analyses of July 3,1979 on a proposed export to Austria (see XSNM01428, SECX-78-656A),and of December 8, 1978 on a proposed export to EURATOM (see XSNM01241,SECY-78-645A).
Among other things, the Executive Branch's. November 10, 1980 memorandum notes that:
-- The July 3,1979 Executive Branch analysis on XSNM01428 for HEU to Austria identified ASTRA as a reactor which can be converted to the use of lower enriched fuels. The materials covered by applications XSNM01726 and XSNM01727 are pursuant to the cooperative US-Austria pro-gram to reduce enrichment of research reactor fuels.
These materials will be used for the fabrication of prototype fuel elements for testing in the ASTRA. The HEU, requested under application XSNM01725 will permit the continued operation of the ASTRA reactor,while the medium and low enriched fuels are being tested.
-- Austria has an in-country inventory of approximately 2.5 kilograms of U-235 in the form of high enriched uranium.
Annual fuel consumption rate at normal operating level is approximately 1.77 kilograms U-235.
The amount of HEU requested in XSNM01725 would, therefore, permit operation of the ASTRA reactor until the end of 1983.
However, depending on the rate at which the lower enriched (45% and 19.9%)
prototype fuel elements are able to be incorporated into the reactor, the HEU under XSNM01725 may permit operation of the reactor beyond the end of 1983.
In examining the three proposed export licenses for Austria, the staff noted that the government of Austria had not provided written assurances regarding the levels of physical protection to be provided U.S.-origin nuclear materials in Austria, as required by 10 CFR 110.43.
By letter dated November 25, 1980 we requested the Department of State to obtain these necessary assurances from the Austrian Government. On December 15,IP received a letter from State which forwarded a written assurance from the Embassy of Austria regarding maintenance of physical

INFCIRC/225/Rev.1, with respect to the Laterials identified in export. license applications XSNM01725,1726 and 1727, The staff notes that the President has issued Executive Order 12193 dated February 12, 1980 extending the exe70 tion of EURATOM from certain requirements of Section 127 of the Atomic Energy Act, as amended, for a period of twelve months through March 10, 1981.
International The proposed exports will be covered by IAEA safeguards in the Safeguards FRG and Austria and by EURATOM safeguards in France. Although insufficient information is available to fully evaluate the adequacy of IAEA safeguards in Austria, staff believes that accounting for and control of the reactor fuel elements on an item i
basis is within the capabilities of Austria and the IAEA.
A detailed analysis of IAEA safeguards at NUKEM was transmitted to the Commission in SECY 80-207, and is also discussed in a recently approved export of HEU to the FRG (see SECY 80-430A, Classified).

France is not a party to the NPT, but has signed a safeguards f
agreement with the IAEA under its voluntary offer.
However, it is unlikely that this agreement will be implemented in the near future.
We have no information on whether CERCA would be listed as an eligible facility for application of IAEA safeguards under this agreement.
EURATOM has a resident inspector at CERCA for application t
of EURATOM safeguards.
Staff has reviewed the physical security programs in the FRG, France and at the ASTRA reactor, and found them in accordance with 10 CFR 110.42 and 110.43.

This letter is in response to the letter from your office dated September 17, 1980, requesting Executive Branch views as to whether issuance of an export license in accordance with the application hereinafter described would be inimical to the common defense and security of the United States and whether the proposed export meets the applicable criteria of the Atomic Energy Act of 1954, as amended by the Nuclear Non-Proliferation Act of 1973:

EURATOM has adhered to the provisions of its Agreement for Cooperation with the United States.
The proposed export to the ultimate consignee for loading into the ASTRA Research Reactor would take place pursuant to the Agreement for Cooperation Between the United States and Austria as confirmed in a letter from the Embassy of Austria, a copy of which is enclosed.
The Executive Branch has reviewed the application and concluded that the requirements of the Atomic Energy Act, as amended by the Nuclear Non-Proliferation Act of 1978, have been met and that the proposed export will not be !nimical to the common defense and security of the United States. A detailed analysis for Austria was suomitted July 3,1979 for NRC application No. XSNM01423. There has been no material change in circumstances since that submission. A detailed analysis for EURATOM was. submitted December 3,1973 fcr NRC application No. XSNM01:41. . Section 126a(2) of the Atomic Energy Act of 1954, as amended, to March 10, 1981, that detailed analysis remains valid. - There has been no other material change in circumstances since that submision.
In the analysis which accompanied the July 3,1979 Executive Branch recommendation for issuance of license XSNM01428 for the export of 3.8 kilograms of 93.3 percent enriched uranium, we explained that the ASTRA has been identified as a reactor which can be converted to the use of lower enriched fuels.
The provision of HEU. under application XSNM01725 will permit the continued operation of the reactor while the medium and low enriched fuels are being tested.
Austria has an in-country inventory of approximately 2.5 kilograms of U-235 in the fctm of highly-enriched uranium. Annual fuel consumption rate at normal' operating level is approximately 1.77 kilograms U-235. The amount of HEU requested in this application would permit operation of the ASTRA Reactor until 1983. A favorable Executive Branch recommendation is being submitted under a separate letter with respect to export requests XSNM01726 and 1727 for medium-enriched (45%) and low-enriched (19.9%) uranium for the fabrication of prototype fuel elements for testing in ASTRA. Depending on the rate at which these prototype fuel elemects are able to be incorporated into the reactor, the HEU being requested under this application will permit operation of the reactor beyond the end of 1983.
On the basis of the foregoing, the Executive Branch recommends that the license be issued.

There has been no other material change in circumste1ces since that submission.
In the analysis which accompanied the July 5,1979 Executive Branch recommendation for issuance of license XSNM01428, we explained that the ASTRA has been identified as a reactor which can be converted to the use of lower enriched fuels. The proposed exports are pursuant to the cooperative U.S.-Austria program to reduce enrichment of research reactor fuels.
On the basis of the foregoing, the Executive Branch recommends that the licenses be issued.

I refer to your letter dated November 25, 1980 regarding physical security assurances with respect to enriched uranium fuel for the ASTRA research reactor in Austria requested under export license applications XSNM017.25,1726 and 1727, now under review by the NRC.
A written assurance regarding maintenance of physical security protection at levels comparable to that set forth in INFCIRC/225 Revision 1, with respect to the material identified in export application XSNM01725,1726 and 1727, has been received from the Embassy of Austria. A copy of this assurance is enclosed.
It is the judgment of the Executive Branch that for the currently pending nuclear export license applications for Austria, XSNM01725,1726 and 1727, the above cited assurance should be deemed to meet the requirement of Section 127 (3) of the Atomic Energy Act since it confirms that a level of protection will be maintained equivalent to that set forth by the Commission in Section 110.43 of title 10 of the Code of Federal Regulations, which was promulgated pursuant to Section 304(d) of the Nuclear Non-Proliferation Act of 1978.
