Dear Mr. Porco:
j We have reviewed your letter of May 9, 1997, in which you asked the NRC whether changes were i
warranted to Ellis & Watts (E&W) procedure ENG-109 regarding identification of materials of j
construction as critical characteristics. Your request was based upon a May 1, 1997, letter to E&W from the Tennessee Valley Authority (TVA) requesting you to revise ENG-109 to indicate that 4
materials may not always be a critical characteristic. While we regret that we cannot respond to your specific questions regarding revision of your )rocedure ENG-109, the attached document
'NRC Commercial Grade Procurement and Dedication Worksiop," dated April 21 and 22, 1993, addresses the NRC's approach to assessing the identification and verification of critical j
characteristics.
In addition, we provide the following information.

Criterion III of Appendix B to 10 CFR Part 50, " Design Control," requires, in part, that 1
i measures shall be established for the selection and review for suitability of application of materials, parts, equipment, and processes that are essential to the safety-related functions
}
of the structures, systems and components. Based on the above criterion, the licensee or supplier is responsible for identifying the design, material, and performance (critical) characteristics that have a direct effect on the item's ability to accomplish its safety i
i function. There may be instances where licensees or suppliers could technically justify that a i
material is not a critical characteristic.
In such instances, justification needs to be based i
on the application and environment of the item being dedicated and supported by purchaser j
documentation.

In addition, we provide the following information.
