CHAIRMAN JACKSON: Good morning ladies and gentlemen. This is an affirmation session. We have one item to come before us this morning. Before I ask the Secretary to lead us through the item for affirmation, and before I ask my fellow Commissioners if they have any opening comments, I would like to make note of the fact that this is Commissioner Rogers' last Affirrnation Session. I'm sure it breaks his heart. (Laughter) Do any of my fellow Commissioners have any opening comments they would like to make?
COMMISSIONER DIAZ: Should we discuss whether this is his last?
(Laughter)
CHAIRMAN JACKSON: Mr. Secretary, please proceed.
MR. HOYLE: Chairman Jackson, we have one item this morning. It is SECY-97-129. In this paper, the Commission is being asked to act on an Order responding to petitions from Louisiana Energy Services and the NRC Staff for review of the Licensing Board's decision LBP-97-8. Each of you has voted to approve the Order, including a footnote which discusses a briefing schedule which grants the petitions for review. The Order also turns down as outside NRC limits NRC rules Nuclear Energy institute's effort to file an amicus curiae brief in support of the petitions but authorizes NEl to file an amicus brief on the merits should it chose to do so. Commission Dieus also voted to approve this paper.
