Last year the fluclear Regulatory Commission sponsored regional workshops for States to review and comment on draft site suitability criteria 'and other issues related to the licensing of high-level radioactive waste disposal in geologic repositories. That is the disposal technology which '

has roccived the most emphasis by the Dcpartment of Energy and its prede-cessor agencies. At the workshops, we discussed a number 0 issues relating to State participation'in the licensing process as well as in the development of new regulations and procedures. There was general agreement that State officials should have early involvement in the devel-opment of draft regulations. I want to ask your help now on some very substantial issues where we need State views. l flRC has approved for publication in the Federal Register a prcposed policy statement on procedures to be used in the licensing review of geologic repositories. A copy of this proposed policy statement and the Federal Register flotice are enclosed for your information (Enclosure 1); '

A regulation applicable to the disposal of high-level wastes in geologic repositories _is under preparation by the staff. The first part of this regulation contains general administrative provisions, licmsing provisions and provisions for State participation.

The purpose of this letter is to solicit State comment o., se staff working draft of this part of the regulation (Enclosure 2). Any comments you make will be considered in preparing the proposed regulation which will be published in early 1979 in the Federal Register. .In order to meet this schedule, we would welcome your comments within sixty days.

Ile ask that you consider the following in your review:

1) Are the draft procedures understandable?
2) Do the procedures provide for an orderly and open process for licensing of geologic repositories? Uhat improvements do you

requirements. We anticipate that the technical requirements of the regulation and the preliminary draft environmental impact statement will be available for State review in early 1979.
